The Board imposes against Operator the following CORRECTIVE ACTIONS: <br /> Operator shall: <br /> 1. Submit a complete 110d Reclamation Permit application within 60 days of the <br /> effective date of this Order and obtain approval of the application within <br /> statutory timeframes; and <br /> 2. Submit,within 30 days of the effective date of this Order, an interim financial <br /> warranty in the amount of$130,323.00 to cover the costs of reclaiming the <br /> affected lands. <br /> The Board imposes a CIVIL PENALTY for 60 days of violation pursuant to <br /> section 34-32-124(7), C.R.S. at $200 per day for a civil penalty of$12,000, which <br /> shall be due and payable within 30 days of the effective date of the Board Order. <br /> Failure to submit any due and unpaid civil penalties by the date specified above <br /> shall result in immediate submittal of such penalties to State collections. <br /> DONE AND ORDERED this—] day of 2022. <br /> FOR THE COLORADO MINED LAND <br /> RECLAMATION BOARD <br /> Nell am- <br /> NOTICE OF JUDICIAL REVIEW RIGHTS <br /> This order becomes effective and final upon mailing. Any party adversely affected <br /> or aggrieved by agency action may commence an action for judicial review by filing <br /> a complaint with the district court within thirty-five (35) days after the effective <br /> date of this order, pursuant to section 24-4-106, C.R.S. (2021) and the Colorado <br /> Rules of Civil Procedure.
