TOWN OF NUNN SPECIAL USE APPLICATION <br /> VIP MINE LLC <br /> I <br /> THE TOWN BOARD OF THE TOWN OF NUNN HEREBY APPROVE THE VIP MiNE LLC SPECIAL USE FOR A <br /> MINING OPERATION IN THE VARRA INDUSTRIAL PARK SUBDIVISION FIRST FILING. IN THE TOWN OF <br /> ! NUNN. <br /> WHEREAS.VIP MINE LLC submitted a Special Use Application for sand and gravel operations in the Varra Industrial <br /> Park Subdivision First Filing. <br /> 1 More Sgecificalh- <br /> Lots 5 thru 6 of Block 4 and Lots 1 thru 10 of Block 5 of the Varra Industrial Park Subdivision First <br /> Filing, including a 60-foot Right-of-Wa% being the westernmost 440 feet of Birch Street. Containing 40 <br /> i <br /> acres more or less. <br /> CONDITIONS OF APPROVAL: <br /> 1. Require full compliance with all state and federal regulations. <br /> 2 Thic Conditional I Ice Approval shall be reviewed annually by the Town Staff.and report of compliance with <br /> the Conditions of Approval provided to the Planning Commission and the Board of Trustees. <br /> ! 3. This Conditional Use Approval may be revoked for non-compliance with the conditions of approval, or non- <br /> compliance with requirements of the Nunn Municipal Code <br /> 4. This mining operation approval is conditional on the approval of the Colorado Division of Reclamation Mining <br /> and Safety(CDRMS) 112 permit. <br /> 5. VIP MiNE LLC vtitill abide by all criteria of the approved CDRMS 112 permit including revegetation of the <br /> mined area. <br /> ` 6. VIP MINE LLC will provide full responsibility for sweeping and clearingg of debris from the paved intersection <br /> I of WCR 29 and WCR 100. 1/4 mile in each direction during the life of the mining operations. <br /> 7 VIP MINE LLC will install a Vehicle Tracking Control (VTC)device per the CDOT standard VTC-1 <br /> (Aggregate Vehicle Tracking Control), detail attached, north of the intersection of WCR 29 and WCR <br /> 100 on Industrial Drive. <br /> j 11. VIP MINE LLC will provide dust control for Industrial Drive and the mining operation as needed to mitigate <br /> dust created by the mining operation. <br /> VIP MINE LLC will provide maintenance for Industrial Drive during the life of the mining operation. <br /> 1 9. Hours of operation will be between 7am and 7pm Monday thru Saturday. <br /> s 10. VIP MINE LLC will allow reasonable inspection during business hours b% designated Town Representative <br /> i <br /> I t_ The mining operations will not interfere v%ith public road frontage, public utilities. utilit} casements.access j <br /> casement, drainage easements and/or conveyances. <br /> 12. Projected expiration date is September 2027 and reclamation commence date is March 202:5 i <br /> 13. Reclamation plans will need to be revievved by the Town of Nunn Board of Trustees prior to March 2025. <br /> 14, At the time the mining operation is 75%mined out. VIP MINE LLC will work with the Town of Nunn to f <br /> replat the mined area in order to remove and/or relocate existing Rights-of-Way, utility and drainage <br /> casements,access casements and turn the effected lots into 'i racts' or 'Outlots', if the Town so chooses. 1 <br /> i <br /> if the Town of Nunn wishes to create 'Tracts*or 'Outlots', the Town of Nunn then accepts dedication of <br /> the property and maintenance, via the replating. <br /> APPROVED AND PASSED BY A MAJORITY VOTE OF THOSE ELECTED TO THE TOWN BOARD OF THE <br /> TOWN OF NUNN.
