Avery Construction Pit, File No. M-1979-010, Structure Agreement — Fiber <br />Optic Cable <br />Mr. West: <br />Pursuant to DRMS Rule 6.4.19, this letter is to document an appropriate engineering evaluation that <br />demonstrates the fiber optic cable will not be damaged by activities occurring at the mining operation. <br />The fiber optic cable is at an approximate 3-FT depth and will remain 98-Feet away from the start of <br />excavation activities. Furthermore, the fiber optic cable will be shielded by a berm to prevent traffic from <br />crossing over the fiber optic cable in all areas except the designed mine entrance. If at any point the fiber optic <br />cable is damaged by mining operations, ACA Products, Inc. will be responsible for the monetary repairs. <br />Thank -you for the opportunity to complete this analysis.
