<br /> <br />NOTICE OF PROPOSED DECISION <br /> <br /> <br />The Colorado Division of Reclamation, Mining and Safety proposes to approve Technical Revision <br />Application No. 76 (TR-76) for the New Elk Mine (Permit No. C-1981-012), submitted by New Elk <br />Coal Company, LLC. This revision (TR76) proposes to change a currently approved light use road <br />to a haul road and extends the haul road for a total length of about 2.7 miles. This permit boundary <br />extension represents 11.7 acres and the proposed additional affected area was historically disturbed <br />in the former railroad bed (including side slopes, culverts, and access trails). The disturbed area is the <br />running surface of the new road (along with berms or other areas of disturbance associated with <br />construction of the road) that represents 6.4 acres (see proposed Map 1 and Map 15a). <br /> <br />The New Elk Mine is a/an underground coal mine located in Las Animas County, approximately 25 <br />miles W of Trinidad, Colorado. Coal interest is state and private, and the surface affected is state and <br />private land. The permit area encompasses approximately 4,201.90 acres. <br /> <br />This proposed decision is based on a finding of whether the proposed operation will comply with all <br />requirements of the Colorado Surface Coal Mining Reclamation Act, Section 34-33-101, et seq., <br />C.R.S., and the regulations promulgated thereunder. <br /> <br />The revision application, as well as all other permit documents, can be viewed at <br />https://dnrweblink.state.co.us/drms/search.aspx by searching C1981012 in the “Permit No” field. <br />A user guide is available to help first time users of the imaged document system and can be viewed <br />at https://drive.google.com/file/d/1l8OUdf_Mpjo3kxIHkP5hMH-w7MeBtxX7/view. <br /> <br />Persons with an interest that may be adversely affected by the proposed decision may request a formal <br />hearing before the Mined Land Reclamation Board on the proposed decision. Such request must be <br />made within ten (10) days of the date following initial publication of this notice, must be in writing, <br />and must state with reasonable specificity the reasons for the request and the objections to the <br />proposed decision. <br /> <br /> <br />
