COLORADO <br /> \/ Division of Reclamation, <br /> ® Mining and Safety <br /> Department of Natural Resources <br /> August 19,2022 <br /> Cheryl Monger <br /> 4786 County Road 312 <br /> New Castle,CO 81647 <br /> Re: The Legacy Mine,Notice of Intent to Conduct Exploration (NOI)Application <br /> Notice of Deficiency#1 <br /> Dear Cheryl Monger: <br /> On August 8, 2022 the Division of Reclamation, Mining and Safety (Division) received your Notice of <br /> Intent to Conduct Exploration Operations package for the Legacy Mine located in Moffat County. The <br /> Division has reviewed the revised application materials that were submitted and deemed the information <br /> deficient. Please provide the following information for the Division's review: <br /> • The Division received an incorrect application NOI fee for the Legacy Mine in the amount <br /> of$108.00. The NOI fee amount required is $86.00. The Division will void the previous <br /> fee received. <br /> • Per Rule 5.1.2(d)(vi), documentation of legal right to enter is necessary prior to approval of the <br /> NOI from the Division.Prospectors will need to obtain a NOI or POO(Plan of Operation)approval <br /> from the BLM to satisfy this rule.The NOI with the Division only grants the right to the requested <br /> minerals but not the right to remove those minerals. A letter or email from the appropriate BLM <br /> field office,which references the proposed project is enough to satisfy the Division's requirements. <br /> Per Rule 5.1.3(a),the Division's review will begin within the twenty working day period when the <br /> Office has received notification from the appropriate federal land management agency that they <br /> have received the notice of proposed activities, or the Office has otherwise determined that the <br /> appropriate federal land management agency has received the notice. <br /> • In reviewing the materials submitted, no bonding has been provided with the Legacy Mine <br /> application. Per Rule 5.3.3(1),upon filing the Notice of Intent to Conduct Exploration,the person <br /> shall provide Financial Warranty in the amount of two thousand dollars($2,000.00)per acre of the <br /> land to be disturbed,or such other amount as determined by the Office,based on the projected costs <br /> of reclamation.
