The Division will require the operator to provide proof that sampling can be <br /> completed with consistency and in accordance with approved methods for the <br /> site for one complete quarter(April through June 2022). <br /> 3. The Division will require the operator to provide proof of compliance with the <br /> approved discharge permit for one complete quarter(April through June 2022). <br /> At the end of June 2022,GIR may provide a demonstration of compliance with the <br /> items stated above and reconsideration for the Division to remove the Cease and <br /> Desist Order placed by the Board. <br /> Ex. C,p. 1. <br /> GIR has complied with all of the above requirements. A new water treatment system was <br /> installed at the Cross Gold Mine("Cross Mine")in December 2021. Ex. D,¶3 (Aff. of S.Muller). <br /> On March 1, 2022, the Division approved GIR's Technical Revision No. 10, which included <br /> approval of the Cross Mine's new water treatment system. Id. at¶4. Following the installation <br /> of the water treatment system, GIR, as operator of the Cross Mine, has submitted monthly water <br /> sampling test results to the Division. Id. at¶5. These water sampling test results included results <br /> for April through June 2022, as required by the Division. Id. GIR also timely paid the required <br /> interim financial warranty in the amount of$162,841.00.Id.at¶6.On July 7,2022,GIR submitted <br /> to the Division a quarterly report,which outlined the activities undertaken at the Cross Mine during <br /> the current quarter along with the planned activities for the next quarter. Id. at¶7. <br /> On July 12,2022,after complying with GIR's requirements concerning submission of proof <br /> of water sampling for April through June 2022, GIR submitted a request to the Division seeking <br /> the Division's removal of the Cease and Desist Order("GIR's First Request to Remove Cease and <br /> Desist Order"). Ex. E (GIR's First Request to Remove Cease and Desist Order). The Division did <br /> not acknowledge receipt of GIR's First Request to Remove Cease and Desist Order or otherwise <br /> respond to it. Having heard nothing from the Division, on July 21, 2022, GIR submitted another <br /> request to the Division seeking the Division's removal of the Cease and Desist Order ("GIR's <br /> 3 <br />
