PERMIT#:M2019008 <br /> INSPECTOR'S INITIALS:RAR <br /> INSPECTION DATE: 10 August 2022 <br /> OBSERVATIONS <br /> The inspection comprised a regular monitoring inspection. The Permittee (McCormick Excavation&Paving <br /> LLC.),was represented by James McCormick throughout the inspection. Rudder Pit is accessed from <br /> Highway 71 and is located approximately 24 miles south of Last Chance. This is a 110c permit for sand <br /> utilized in construction of local road projects with government agencies(town,county). Excavation <br /> occurs in the streambed of the Arikaree River. Material was removed in spring of 2022. Generally <br /> material is excavated in spring and early winter,depending on ongoing projects. <br /> Excavation occurs between the banks of the Arikaree River. The stream banks define the permit <br /> boundary. Excavation is proceeding from south to north and there was a change in elevation of <br /> approximately 2.5 to 3 feet between unmined stream bed and the portion that has been excavated(Photo <br /> 2). The excavated area exhibited depressions in the stream bed of approximately 8 inches in depth(Photo <br /> 3). <br /> Availability of Records: The site is permitted for 9.9 acres,with an approved post-mining land use of <br /> pastureland. There are no open infractions. No previous inspections are on record. <br /> Financial Warranty: This pit is permitted by McCormick Excavation&Paving,LLC, and DRMS holds <br /> a bond of$5,270.00 as required. <br /> Fish and Wildlife: No impact to fish or wildlife was observed. <br /> Hydrologic Balance: No standing water was observed in the riverbed,where excavation occurs and no <br /> exposed groundwater was observed. Any runoff or snow melt drains into the river bed and infiltrates into <br /> the sandy soils. Any water intercepted must be released to the stream within 72 hours. <br /> Compliance with Mine Plan: The operation appeared to be in compliance with the approved mine plan. <br /> No activity was observed at the time of inspection. No equipment was staged at the site at the time of <br /> inspection. <br /> Off-site Damage: The operation appeared to be confined to the permit boundary. <br /> Processing Waste: No processing waste was observed at the time of inspection. <br /> Roads: There is no defined road. <br /> Reclamation Success: No reclamation had been initiated at this site at the time of the inspection. <br /> Revegetation: No revegetation had been initiated at this site at the time of the inspection. The site <br /> vegetation comprises native grasses and forbs in undisturbed areas and sparse vegetation mostly made up <br /> of minor annual weeds in the area that has been excavated. <br /> Sediment Control: No active erosion was observed at the time of inspection. <br /> Signs and Markers: The permit id sign was posted at the entrance (Photo 1),exhibiting all required <br /> information. <br /> Permit Stipulations: There are no permit stipulations. <br /> Storm Water MGT Plan: No oil or fuel spills observed. Any runoff from precipitation drains to the <br /> stream bed and infiltrates. <br /> Page 2 of 5 <br />
