PERMIT#:M-1986-104 <br /> INSPECTOR'S INITIALS: LDS <br /> INSPECTION DATE: June 13,2022 <br /> OBSERVATIONS <br /> This inspection was conducted as part of the normal monitoring program established by the Colorado Division <br /> of Reclamation, Mining and Safety (Division). The inspection was conducted by Leigh Simmons of the Division, <br /> and accompanied by Jason Burkey of Oldcastle Materials (permitee and operator). <br /> The Montgomery Pit is a 112c operation with a total permit area of 46.1 acres, located 1.5 miles west of Eagle, <br /> Colorado. Mining at the Montgomery Pit is complete, and the site is now used by Oldcastle Materials for <br /> asphalt processing, material stockpiling, and as their regional office. The industrial facilities installed at the site <br /> are permanent in nature and were in active use at the time of the inspection. <br /> The post-mining land use of the site was changed from "rangeland" to "industrial/commercial" with the <br /> approval of AM-1 on October 15, 2003, on the condition that the operator obtained an appropriate land use <br /> permit from Eagle County. A copy of the county permit was received by the Division on March 26, 2008. <br /> The Division currently holds a financial warranty of$83,830 for the reclamation of the site. Since the site is <br /> currently being used for its approved post-mining land use the Division recommends that the operator <br /> considers submitting an application for financial warranty release, (the procedure is laid out in Rule 4.17 of the <br /> Construction Materials Rules). <br /> Page 2 of 4 <br />
