BEFORE THE MINED LAND RECLAMATION BOARD <br /> STATE OF COLORADO <br /> FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br /> IN THE MATTER OF THE APPLICATION FOR 112C PERMIT OF YOUNG <br /> RANCH RESOURCE LLC; File No. M-2021-009 <br /> THIS MATTER came before the Mined Land Reclamation Board ("Board") on <br /> June 22, 2022 via videoconference for a hearing to consider the application of Young <br /> Ranch Resource LLC ("Applicant") for a 112c permit, file number M-2021-009. <br /> Amy Eschberger, Michael Cunningham, and Senior Assistant Attorney <br /> General Scott Schultz appeared on behalf of the Division of Reclamation, Mining <br /> and Safety ("Division"). Robert Young, Jr.; Mark Lacis, Esq.; Mamie Ling, Esq.; Ben <br /> Langenfeld, P.E. of Lewicki &Associates; and David Blauch, PWS of ERC, Inc. <br /> appeared on behalf of Applicant. Objectors Clare Stone, Jonalyn Agar, and Dienne <br /> Powell appeared on their own behalf. <br /> The Board, having considered presentations, testimony, materials submitted, <br /> and being otherwise fully informed of the facts in the matter, enters the following: <br /> FINDINGS OF FACT <br /> 1. Applicant filed an application with the Division for 112c reclamation <br /> permit for a site known as the Young Ranch Resource Quarry in Gilpin County and <br /> Clear Creek County, Colorado ("Application"). Located in Section 28, Township 3 <br /> South, Range 72 West, 6th Principal Meridian, the Young Ranch Resource Quarry <br /> would mine granite, gneiss, and gravel for construction aggregate to be processed at <br /> on-site facilities. <br /> 2. The Application proposes a total of 469.7 permitted acres, with a total <br /> 335.1 acres to be affected by the operation. The Application's mining plan <br /> anticipates using conventional drill and blast techniques to ultimately develop two <br /> large excavation areas with highwalls maintained at benched configuration. The <br /> site will include crushing, screening, and washing of aggregate products_ The <br /> operation will proceed through five phases of operations with concurrent <br /> reclamation as the operation progresses. <br /> 3. In accordance with Rules 1.6.2(1)(d) and 1.6.5(1) of the Mineral Rules <br /> and Regulations of the Colorado Mined Land Reclamation Board for the Extraction <br /> of Construction Materials, 2 CCR 407-4 ("Rules"), the Applicant published notice in <br /> the Clear Creek Courant, the Mountain-Ear, and the Weekly Register-Call once a <br /> week for four consecutive weeks and mailed required notices in accordance with the <br />
