Hiner Construction Co. (Hiner), please accept the following technical <br /> revision request for the Greeley Pit, Permit No. M-1977-151. This will be the third technical <br /> revision of the permit and is intended to address the issues identified in your March 25, 2022, <br /> inspection report for the pit and reiterated in your July 7, 2022, extension request approval. <br /> The Greeley Pit is a permitted sand and gravel pit located in the NE '/4 of Section 36, Township 6 <br /> North, Range 66 West and the NW '/4 of Section 31, Township 6 North, Range 65 West of the 6th <br /> P.M. as shown in Figure 1, attached. Past mining at the site has resulted in approximately 71.8 <br /> acres of exposed groundwater in three distinct water bodies. Of this amount, approximately 40.2 <br /> acres were exposed prior to 1981 and therefore do not require augmentation. The net exposed area <br /> remaining not considered pre-1981 is therefore 31.6 acres. Pursuant to the current Substitute <br /> Water Supply Plan (SWSP) for this site approved by the Colorado Division of Water Resources <br /> (DWR) on May 13, 2022, the net evaporation rate is this area is 33.11 inches per year, totaling <br /> 87.19 acre-feet of evaporative loss per year from the net exposed groundwater area. <br /> In order to comply with Colorado Division of Reclamation, Mining, and Safety (DRMS) <br /> requirements for the protection of water resources, Hiner has adopted Approach No. 4 outlined in <br /> the DRMS letter dated April 30, 2010. Hiner currently own 6.25 Greeley Irrigation Company <br /> (GIC) shares, and a notarized affidavit dedicating these water rights to the Greeley Pit SWSP was <br /> executed on April 1, 2020. Each share of GIC provides approximately 10.31 acre-feet of <br /> consumptive use credit per year; therefore these 6.25 GIC shares provide approximately 64.44 <br /> acre-feet per year of consumptive use credit on average. The long-term net evaporative loss from <br /> the current exposed area is 87.19 acre-feet per year as established in the current SWSP. Because <br /> the 6.25 GIC shares are insufficient on their own to cover all long-term evaporative depletions, <br /> Hiner intends to cover the difference (22.75 acre-feet per year) by backfilling portions of the <br /> exposed area and acquiring additional GIC shares for dedication to the site(as such shares become <br /> available). <br /> www.applegategroup.com Denver • Glenwood Springs • Hotchkiss (303)452-6611 <br />
