Bureau of Land Management Finding of No Significant Impact <br /> Royal Gorge Field Office DOI-BLM-CO-F020-2020-0036 EA <br /> conditions applied in the permit in no way insulates or releases it from any liability or <br /> obligations which may arise with respect to its operations under any applicable <br /> environmental law, including but not limited to the Comprehensive Environmental <br /> Response,Compensation, and Liability Act(CERCLA),42 U.S.C. 9601 et seq. The <br /> United States reserves its rights and claims under CERCLA to seek performance of <br /> response actions and/or reimbursement of response costs that may be incurred as a result <br /> of any release or threat of a release of a hazardous substance from the permitted area,or <br /> any ancillary operation for the mining activity. <br /> Because this project involves use of oil or fuel,transfer and/or storage, an adequate spill <br /> kit is required to be onsite. The project proponent will be responsible for adhering to all <br /> applicable local, State and Federal regulations in the event of a spill of petroleum <br /> substances,which includes following the proper notification procedures in BLM's Spill <br /> Contingency Plan. <br /> 14. Water Quality Surface and Ground—Depth to static groundwater level should be <br /> determined before conducting any mining activities to make sure these activities would <br /> not impact groundwater anywhere in the project site. <br /> Positive impacts include benefits in royalties and revenue generated to the federal government <br /> and severance taxes to state and county governments from the quarry production. Since the <br /> existing mine and proposed expansion are located a quarter of a mile north of the City of Silver <br /> Cliff,the growing community and surrounding municipalities would directly benefit from the <br /> availability of local mineral materials. The expansion would not only provide the operation with <br /> additional reserves and an extended mine life,but also expand the production rate and <br /> subsequently increase job opportunities. <br /> Public health and safety: <br /> The proposed action will not have significant impacts to air or water quality. In addition, <br /> physical safety is addressed during the mining operations through administrative and engineered <br /> controls, as well as outlined within this EA and mandated by MSHA(Mining, Safety and Health <br /> Administration). <br /> Unique characteristics of the geographic area: <br /> The EA evaluated the area of the proposed action and determined that no unique geographical <br /> characteristics, such as wild and scenic rivers,unique farmland, areas of critical environmental <br /> concern, designated wilderness areas, wilderness study areas, or lands with wilderness <br /> characteristics,were present. <br /> Degree to which effects are likely to be highly controversial: <br /> 4 <br />
