South Hinsdale Response to Objections <br /> 12 July 2022 <br /> Individuals and Other Permitting <br /> Several objectors claimed that this project involved individuals associated with other gravel mining <br /> applications and operations, and that this was an attempt to overcome projects that were denied <br /> by various counties. These claims, misunderstandings, and related issues are addressed in this <br /> section. <br /> 1. Mr. Rogr ?�Urbancyzk <br /> Mr. Urbancyzk, his businesses, and his family and firm (Silesia Properties LLC) has no connection <br /> with this project. (Mr. Urbancyzk is a resident of San Antonio, NOT Houston.) <br /> 2. Oakbrush Hill Gravel operation <br /> The Oakbrush Hill Gravel permit application with Archuleta County and Colorado DRMS was not <br /> denied. It was withdrawn by the applicant, C&J Gravel Products of Durango, when the landowner <br /> sold the property.C&J Gravel Products is not associated with this current application.WASTELINE, <br /> Inc. did prepare and submit permit applications and did research and design associated with that <br /> project, which was withdrawn by Silesia Properties LLC. <br /> 3. WASTELINE, Inc. <br /> WASTELINE, Inc. is the engineering firm designing and applying for permits for this current <br /> operation and works for the Texers and their business enterprises. WASTELINE has been working <br /> for many firms and some governmental organizations in Southwest Colorado for more than 22 <br /> years, including designing and preparing applications for sand and gravel mining operations. <br /> Among these are(some approved and in operation, some completed, and some denied by County <br /> governments or withdrawn by applicants/landowners): Lob Lolly Pit, Schmidt Site, Two Rivers Pit, <br /> Toner Ranch Pit, Oakbrush Hill Operation, Montoya Pit, Bonds Pit, Ignacio (La Boca) Pit, Schoen <br /> Pit, and others. WASTELINE and its personnel have prepared at least 100 mining permit <br /> applications in seven states including Colorado. <br /> Mr. Nathan Barton is the primary Preparer of this response as well as the permit applications. He <br /> is the Comptroller and Engineering Manager of WASTELINE, Inc., and also an employee and <br /> associate of various firms based in and doing business in Colorado, and other states. He is a <br /> licensed Professional Engineer in the State of Colorado and other jurisdictions, and holds other <br /> licenses and certifications. His experience includes mineral, civil, hydrologic, geologic, <br /> environmental (including air quality, water quality (including storm water and sanitary sewage), <br /> water rights, land quality, and remediation), structural and military engineering. He also trains <br /> personnel on emergency response, hazardous materials, reclamation, mining safety and health <br /> (MSHA), and related subjects. <br /> 4. Location/Home of Applicants/Operators <br /> South Hinsdale Sand and Gravel Company's Registered Agent (as a Colorado business entity) is <br /> Mr. Michael Texer. He does indeed live near Colorado Springs and has a business office in that <br /> city. He and his brother Travis are the principals of the company, and are also the owners of the <br /> Dancing Winds Ranch and the property proposed for mining. They are (like many others) parttime <br /> residents of the South End. Part of the reason for this project is to allow them to become fulltime <br /> residents of the South End and raise their children here. <br /> 5. Persons from or associated with Texas. <br /> There are no direct links between anyone involved in this project and the State of Texas,other than <br /> Mr. Barton has lived in Texas and has Texian ancestors (ancestors date to before Texas was a <br /> republic or a part of the United States). <br /> 5182-22-003 WASTELINE, INC.
