We are requesting that <br /> the mining permit responsibility,liability,and coverage for Wattenberg Pit,Permit M-2005-066,be transferred to <br /> Oldcastle SW Group, Inc. Please find enclosed with this letter the corresponding Transfer of Mineral Permit <br /> and Succession of Operators forms and check for the related fee. <br /> We are including the signed Structure Agreements which we received from some of the owners of structures <br /> within 200 feet of the mining area. In accordance with DRMS regulations, we have also provided an <br /> "engineering evaluation" (Slope Stability Analysis)where such agreements could not be reached. With <br /> regard to Structure agreements,we are including a few comments to note: <br /> a. ME III Corporation—the status of the Perry#3 well is"SI"—Shut In as of 9/1/2020,per the Colorado Oil <br /> and Gas Information System(COGIS)—WELL Information. A copy of a page from the web confirming <br /> the status is enclosed.Additional details are available on the website. <br /> b. TOP Operating-per the Colorado Oil and Gas Conservation Commission("COGCC"),the Facility Status <br /> of the TOP Operating well is"Permanently Abandoned"as of 2/21/2020.A copy of a page from the web <br /> confirming the status is enclosed. Per the inspection report,document number 690101960 which includes <br /> notes from the inspection date of 07/06/2020,page 2 of 2,the(Ditirro John 1-A)has been plugged and <br /> abandoned and the facility/battery has been decommissioned—al equipment removed." Although Paul <br /> Herring of TOP Operating said that he would sign a Structure Agreement last year,in October,2021,he <br /> has not provided us with same,nor has he responded to any follow-up calls or emails that have been sent to <br /> him. <br /> c. Lumen—successor to Quest,returned our certified mail as"unclaimed,unable to forward"in spite of the <br /> fact that the letter was mailed to the address of the representative of Lumen with whom we corresponded <br /> many times. A copy of the returned envelope is enclosed. <br /> d.
