PERMIT#:M-2000-089 <br /> INSPECTOR'S INITIALS:JPL <br /> INSPECTION DATE:June 9,2022 <br /> OBSERVATIONS <br /> The Perdue site was inspected by Patrick Lennberg with the Division of Reclamation, Mining and Safety <br /> (Division/DRMS).The inspection was completed as part of the Division's routine monitoring inspection <br /> program.The site was previously inspected by the Division on September 6, 2018 at the operator's request to <br /> assess remaining reclamation requirements. No one representing operator/permittee was able to accompany <br /> me during the inspection.The Division was given permission to enter the land where the permit is located <br /> from the new land owners Christine LaFortune and Doug Ruppel.The weather was clear. <br /> This is a 110c operation permitted for 9.7 acres.The permit is for the mining of sandstone for building <br /> materials and decorative use.As mentioned above the mine is located on property owned by Christine <br /> LaFortune and Doug Ruppel. However, at the time of writing this inspection report the Boulder County <br /> Assessor site still lists the owner of the property to be Orlando Vasquez.The mine is located in Boulder <br /> County.The site entrance is located approximately 3 miles north of Lyons,CO via Stone Canyon Drive.The <br /> approved post-mining land use is rangeland.A mine sign was posted at the mine entrance pursuant to Rule <br /> 3.1.12. <br /> The mine was not active at the time of inspection and appears that mining activities, including the hauling <br /> away of marketable material, has not occurred for some time. During the last inspection Ignacio Vasquez <br /> stated he intended to complete the required reclamation earthwork and revegetate the site. It does not <br /> appear that the required earthwork took place.Also during the last inspection the Division reminded the <br /> operator that pursuant to Rule 3.1.3 all reclamation has to be carried to completion with all reasonable <br /> diligence and each phase of reclamation shall be completed within five (5)years from when that phase began <br /> reclamation. In this case the five (5)year reclamation period for the site is assumed to have begun in 2018 the <br /> date of the last inspection. <br /> The approved reclamation plan calls for backfilling mined areas with overburden and/or waste rock to a 3H:1V <br /> or flatter slope gradient, replacing topsoil on disturbed land at a minimum depth of 3 inches, and revegetating <br /> the site for rangeland use.The existing driveway used to access the site from Stone Canyon Drive will remain <br /> after reclamation for use by the landowner.There are several steep mine faces that need to backfilled in the <br /> southeast and southwestern areas of the permit.Along with backfilling any available topsoil needs to spread <br /> and seeded with approved seed mix.Additionally,there are several piles and stacks of marketable material <br /> that remain onsite. <br /> Also the site was surrounded by a 110c reclamation only permit, M2012-046.The permit was obtained to <br /> encompass offsite disturbances due to mining activities at the Perdue site, M2000-089.The M2012-046 <br /> permit was released in September 2018 after meeting the approved reclamation requirements. <br /> During the coordination of this inspection the new land owners stated they had completed the required <br /> paperwork to transfer the permit into their name, at the time of writing this report the Division has not <br /> received a Succession of Operators (SO)Application for the site.The new landowners indicated they do not <br /> intend to resume mining operations in the near future. It should be noted the time limit for reclamation is <br /> 2023. If an SO application is not received and the land ownership does change,the current operator will need <br /> to provide documentation of the legal right to enter to conduct mining and reclamation for the owners of <br /> record, pursuant to Rule 6.3.7 Source of Legal Right to Enter. <br /> Page 2 of 9 <br />
