RCVD DWR <br /> Water ResourceAdvisors forthe West 07/24/2 Q 2 0 <br /> July 22, 2020 10004857 <br /> Ms.Melissa van der Poel <br /> State Engineer's Office <br /> 1313 Sherman Street,Room 818 <br /> Denver,CO 80203 <br /> Re: Substitute Water Supply Plan Amendment Request for the Fountain Pit(M-1982-155) <br /> Dear Melissa: <br /> The Fountain Pit (M-1982-155), operated by Schmidt Construction Company (Schmidt), is <br /> covered by a Substitute Water Supply Plan (SWSP) approved by your office pursuant to C.R.S. <br /> §37-90-137(11). The current SWSP expires November 30, 2020. On behalf of Schmidt, Applegate <br /> Group (Applegate) is submitting this request to amend the current SWSP to account for additional <br /> water use at the site and add an additional replacement supply. Applegate intends to pay the $257 <br /> SWSP amendment fee electronically. <br /> AMENDMENT DESCRIPTION <br /> The Fountain Pit is located in Section 13,Township 16 South,Range 66 West in El Paso County. The <br /> site is located approximately two miles south of the City of Fountain and two miles west of I-25. An <br /> overview map is included as Figure 1. <br /> The current SWSP covers up to 4.07 acre-feet per year of groundwater depletions to Rock Creek <br /> resulting from pumping water from an existing sump(Well Permit No. 59834-F);such water is fully <br /> consumed by evaporation and dust control use around the site. The primary replacement source for <br /> these depletions are 20 shares in the Fountain Mutual Irrigation Company (FMIC) that are delivered <br /> to FMIC's augmentation station on Spring Creek. <br /> In addition to the uses already covered by the approved SWSP,Schmidt has additional needs for water <br /> for dust control,aggregate production,and construction activities on and in the vicinity of the Fountain <br /> Pit. In order to provide for that need, Schmidt has executed a lease with Colorado Springs Utilities <br /> (Utilities) for water to be delivered via pipeline to the Fountain Pit. The source of this water will be <br /> the Hanna Wells located on nearby Clear Springs Ranch,shown in Figure 1. <br /> DEPLETIONS <br /> Pursuant to the attached surplus water lease agreement, Utilities will supply Schmidt with up to 250 <br /> acre-feet per year in non-potable water pumped from the Hanna Wells on Clear Springs Ranch. The <br /> Hanna Wells,designated Hanna Ranch Well Nos. 1 through 14,were decreed in Case No.W-1528 and <br /> were most recently used for municipal,industrial,and domestic purposes in conjunction with operation <br /> of Utilities'R.D.Nixon Power Generating Plan located on Clear Spring Ranch.
