RE: Acreage Release Request for phases of Fort Lupton Sand &Gravel Mine, M-1999-120 <br /> Completed Reclamation in Vincent West Phase, Undisturbed Areas (2) <br /> - Division of Water Resources (DWR) Certification and Approval of Liner- The slurry wall liner for the <br /> Vincent West phase was approved by the DWR on March 6, 2019. A copy of the approval letter is <br /> attached for your reference. <br /> - All bank sloping has been completed to the stated 3:1 slopes or flatter. <br /> - All areas above the high water line that are shown as being vegetated in the Vincent West phase's <br /> reclamation plan have been topsoiled and seeded as per the seed mix described in AM-02. Some <br /> areas have been seeded more than once. Effective weed control and maintenance measures have <br /> been implemented since the phase was affected by mining and have been continued after <br /> reclamation. We have attached a few photos of the Vincent West Phase -showing finished slopes, <br /> initial vegetation growth, and weed control. <br /> - As per our permit approval (AM-02), establishment of full revegetation is not required for release <br /> because we have a purchase/sale agreement with the City of Aurora, who will be taking possession <br /> of the property as soon as the acreage is released from the DRMS permit. Our contract has the <br /> Vincent West release area scheduled to transfer to Aurora by Aug ust-September-2022. <br /> - Aurora will continue development of their water storage reservoirs in the next few years. In the <br /> meantime, Aurora has an on-going contract with a land management company that performs <br /> regular weed control and other maintenance on their multiple reservoir properties. The Vincent <br /> West release area will be included in the weed control and land management. <br /> - A copy of the Special Warranty Deed between L.G. Everist and the City of Aurora (Aug-2015) is <br /> attached. (Note: In the purchase/sale agreement and the Special Warranty Deed between the City <br /> of Aurora and L.G. Everist, the area that is designated Vincent West in the DRMS permit is also <br /> known as Everist No. 3 - D-09, and Everist No. 4 - D-10W.) <br /> - We are including a letter signed by the City of Aurora's Water Resources Manager accepting the <br /> completed reclamation of the Vincent West phase as is, with all reclamation completed up to and <br /> including initial seeding. <br /> - We have also attached a few photos of the Hill-Oakley and Fort Lupton East phases to show <br /> evidence of Aurora's finished development and maintenance of previously released phases. <br /> - Graveled access roadways will remain around the perimeter of the Vincent West phase, also as <br /> shown on the reclamation plan. <br /> - A Technical Revision (TR-8) was approved May 31, 2022 to change the reclamation plan for <br /> Vincent West - to revise the shoreline configuration due to the removal of oil and gas structures. A <br /> copy of the TR Approval letter is attached for reference. <br /> - The undisturbed areas of the Vincent West phase include setbacks and a larger area (approx. 5- <br /> acres) which are included in this release request. The 5-acre undisturbed area is located to the <br /> west of the Vincent West reservoir on the other side of the Lupton Bottom Ditch,. This area was <br /> included in the Fort Lupton permit area and in the acreage of the Vincent West phase, but not as <br /> mineable acres.
