Please be as specific
as possible.
Comment/Objection Narrative
I wanted to ensure that this was documented on file with the State. The State requires notice to be available to
the public at the County Clerk to the Boards Office. I was unable to get the information from the County as
advised. I have reached out to both the County Clerk to the Board, Maria Higgins, her Supervisor,Chloe White
and finally was contacted by Bruce Barker,County Attorney. I filed the complaint below with the State AG office
since the information was not available and I was told they"made a mistake."
There is a proposed mining site at the corner of CR396&54th Street Road in Weld County. The State
Reclamation Mining and Safety Board requires notice to be posted and the files be available at the County for
the public to view. The posting directed me to the Weld County Clerk to the Boards office. I called on 6/6/22 and
spoke to Mariah Higgins, the Clerk to the Board and was advised that there are no records available and to
speak to the planning department. Planning department sent me to the City of Evans. After weeks, it has been
determined and proof provided by the State that the County had the documents on file since 4/1/22.The
Supervisor to the Clerk to the Board confirmed in an email the documents were on file. The County failed to
provide the documents to the public when requested directly. There is no response or accountability for their
actions and not following the requirements of the State to share the documents on file for public viewing. I have
records of the calls.
This is a follow up to my previous complaint. I spoke to Bruce Barker, County Attorney for Weld County on
6/29/22. Bruce advised that the County"made a mistake"and didn't provide the information when requested
with regards to the proposed mining site in Weld County. The State Department of Mining, Reclamation and
Safety requires that the information be on file and available to the public at the County Clerk to the Boards
office. When requested, I was told they had no information, sent to planning, who sent me to City of Evans.
While trying to file a complaint of defective notice the State provided proof that the County had the information
on file and didn't share it as required. Bruce stated they made a mistake. The information was not provided as
required by the State statute upon request. How are we to trust the process or information when we get wrong
information when we follow the process outlined by the State.
