Polis, Governor | Dan Gibbs, Executive Director | Virginia Brannon, Director <br /> <br />Nicki Poulos <br />Mountain Coal Company, LLC <br />5174 Highway 133 <br />Somerset, CO 81434 <br /> <br />June 21, 2022 <br /> <br />Re: West Elk Mine (Permit No. C-1980-007) <br /> Minor Revision No. 468, (MR-468) <br /> Initial Adequacy Review <br /> <br /> <br />Dear Ms. Poulos, <br /> <br />The Colorado Division of Reclamation, Mining and Safety (Division) has completed the initial review of <br />materials submitted by Mountain Coal Company, LLC (MCC) in support of the MR-468 application. <br /> <br />The Division understands that the proposed access road is unrelated to mining or reclamation. It is a <br />disturbance to be constructed, and ultimately reclaimed, by DRMS Inactive Mine Program contractors. <br />Since MCC will not be liable for the reclamation of the road, the Division will not bond for it. <br /> <br />As with the recent MR-464, it is important to thoroughly document all disturbance within the permit <br />area so that it can be accounted for. <br /> <br />1. Please update section 2.05.3(3) of the PAP with a complete description of the road, including its <br />location. Please also specify in the text that the disturbance is not a mine facility, and will not be <br />used in the future for any activity associated with mining or reclamation. <br /> <br />2.
