Chavers Mining Resources Substitute Water Supply Plan 2022 Page 5 of 8 <br /> June 27, 2022 <br /> Conditions of Approval <br /> This SWSP is hereby approved in accordance with section 37-90-137(11), C.R.S. subject to the following <br /> conditions: <br /> 1. This SWSP shall be valid for the period of August 1, 2022 through December 31, 2022, unless <br /> otherwise revoked, or superseded by decree. The plan will be extended until July 31, 2023 if <br /> Applicant provides a copy of the lease extension with the City of Aurora to this office by <br /> November 1, 2022 that includes adequate replacement water to replace all un-replaced depletions, <br /> after accounting for any transit losses. If this plan is not decreed in water court by the SWSP <br /> expiration date, a renewal request must be submitted to this office with the statutory fee of $257 no <br /> later than November 1, 2022 (or June 1, 2023 if extended). If a renewal request is received after <br /> the expiration date of this plan, it may be considered a request for a new SWSP and the $1,593 filing <br /> fee will apply. <br /> 2. During the plan period of August 1, 2022 through December 31, 2022 (or July 31, 2023 if the plan is <br /> extended), the following amounts must not be exceed: <br /> a. total surface area of the groundwater exposed at the Chavers Mining Resources site must not <br /> exceed 5.93 acres, which results in an annual evaporative loss of 16.05 acre-feet per year or <br /> 6.08 acre acre-feet for the period of August 1, 2022 through December 31, 2022; <br /> b. the water used for dust control at the Chavers Mining Resources site shall not exceed 1.25 <br /> acre-feet per year or 0.52 acre-feet for the period of August 1, 2022 through December 31, <br /> 2022; <br /> c. the total product mined at the Chavers Mining Resources site shall not exceed 700,000 tons per <br /> year or 279,000 tons during this SWSP period, which results in 20.61 acre-feet per year of <br /> water lost with the mined aggregate or 8.21 acre-feet for the period of August 1, 2022 through <br /> December 31, 2022; <br /> d. the total concrete production shall not exceed 154,000 cubic yards per year or 68,190 cubic <br /> yards during this SWSP period, which results in 14.18 acre-feet per year of water used for <br /> concrete production or 6.28 acre-feet for the period of August 1, 2022 through December 31, <br /> 2022; and <br /> e. total consumption at the Chavers Mining Resources site must not exceed these aforementioned <br /> amounts unless an amendment is made to this SWSP. <br /> 3. Approval of this SWSP is for the purposes as stated herein. This office must first approve any <br /> additional uses for the water. <br /> 4. All pumping for dust control shall be measured in a manner acceptable to the Division Engineer. <br /> 5. Well permit nos. 80120-F and 80121-F were issued for the gravel pit site in accordance with sections <br /> 37-90-137(2) and (11), C.R.S. and these permits remain valid. <br /> 6. The replacement water that is the subject of this SWSP cannot be sold or leased to any other entity. <br /> As a condition of subsequent renewals of this SWSP, the replacement water must be appurtenant to <br /> this site until a plan for augmentation is obtained. All replacement water must be concurrent with <br /> depletions in quantity, timing, and locations. <br /> 7. The Applicant shall provide daily accounting (including, but not limited to diversions, depletions, <br /> replacement sources, and river calls) on a monthly basis. The accounting must be uploaded to the <br /> CDSS Online Reporting Tool within 30 days of the end of the month for which the accounting applies <br /> (https://dwr.state.co.us/Tools/reporting). Instructions for using the tool are available on the Division <br /> of Water Resources website on the "Services" --+ "Data Et Information" page under the heading of <br /> Online Data Submittal. Accounting and reporting procedures are subject to approval and modification <br />
