2.05 APPLICATION FOR PERMIT FOR SURFACE OR UNDERGROUND MINING ACTIVITIES B <br />MINIMUM REQUIREMENTS FOR OPERATION AND RECLAMATION PLANS. <br />Backfilling and Grading <br />1. During 2000 50 feet of common dirt material was placed in the <br />bottom of the ventilation shaft and the remaining portion of the shaft <br />was filled with refuse material. In 2002 significant settling was <br />discovered to the extent that all of the material placed in the shaft <br />may have flowed out of the shaft and into the adjacent mine <br />workings. In 2002 over 50 feet of large rock and common material <br />was placed in the shaft followed by refuse material and then topped <br />with 50 feet of common material. The backfilled shaft opening was <br />covered with a 12 inch thick concrete cap in 2003. Under <br />( §75.1711 -1) MSHA requires a shaft to be effectively capped or <br />filled. Caps consisting of 6 inch thick concrete are considered by <br />MSHA as an effective cap. Because of the uncertainty of the make <br />up of the shaft backfill, the Operator satisfied MSHA's shaft sealing <br />requirement with the concrete cap. The ventilation shaft area was <br />restored to AOC during 2005. <br />2. The west mine portals were backfilled during 2000. The method for <br />sealing these openings are shown in Volume 6A- Final <br />Abandonment tab, Figure 2.05 -6. <br />3. The West Mine Portal Bench was backfilled with material taken from <br />the East Roatcap Creek Fill, and then topsoil was applied to the <br />reclaimed areas that are restored to Approximate Original Contours <br />and will not be re- disturbed. Work began in 2000 and was <br />completed in 2002. <br />4. The West Mine Sedimentation Pond was reclaimed and replaced by <br />two new sedimentation control ponds, W-1 and W -2 as interim <br />sedimentation control features. <br />5. The West Mine Access Road (that portion that crossed East <br />Roatcap Creek) was reclaimed and returned to Approximate Original <br />Contours in 2002. <br />6. The Pre - mining public access road along lower East Roatcap Creek <br />was restored during the restoration of Approximate Original <br />Contours along the east side of the creek through the East Roatcap <br />Creek Fill. <br />7. The BLM's letter dated December 16, 2003, pages 60i and 60ii, <br />clarifies a number of issues regarding the reclamation work <br />completed during 2002 as follows: <br />• <br />MT-6/MR-126 <br />a. (Item 4) The road leading from the Stevens Gulch road to the <br />former West Mine portal gate should be left in place as is.
