June 13,2022 C-1981-041/Roadside Portals CCW
there was no water discharging from the 4 inch pipe into the landowner's Tract 71 Ditch. There was no
evidence of recent flow in the ditch. The west, middle and east holes were in similar condition to that of
what was observed on June 13th. The waddles on the northwest edge of the TR-69 Repair Area remained
intact. During the inspection the Division observed Mr. Fontanari using his equipment to dig a trench
through the access road underneath the Xcel powerlines. This road may be a portion of Xcel's easement
for the power lines. Mr. Fontanari had a 12 or 18 inch culvert he was planning to bury underneath the
access road. This will connect the eastern portion and northern portion of his ditch on Tract 71. The
work he was doing was east of the TR-69 Repair Area and was not affecting the reclamation. The
Division also observed one riser pipe on the Tract 70 Mesa flowing at full capacity. This riser was the
second south of the Minerals permit boundary. The riser and ditch closest to the boundary was observed
to be damp and muddy; however that riser was not flowing during the inspection. There is also one riser
left within the Minerals permit boundary. This riser was not flowing during the inspection, but the ditch
and soils to the northeast of the ditch were damp and muddy. The damp ditches and muddy soil
indicated that those risers must have been flowing recently and flowing within the Minerals permit.
Please see the photos below for more details of the inspection.
:r
rr
r'
• _ '; .
i
Mr. Fontanari and his employee excavating the access road to place the culvert.
