This Order included a required corrective action for <br /> HCR-High Country Repair(Operator) to submit a conversion application to include the affected lands outside <br /> the approved permit boundary due within 90 days of the Board Order or January 20, 2022. Additionally, the <br /> Operator was assessed an unsuspended civil penalty of $4,300 due within 30 days of the Board Order or <br /> November 21, 2021. During the April 20, 2022 hearing the Board continued the enforcement action to the <br /> July 2022 Board Hearing to allow the Operator additional time to gain compliance. However, due to conflicts <br /> with the Board's agenda this item will now be scheduled to be heard during the August 2022 Board Hearing. <br /> As of the date of this letter, the Division has not received the required conversion application or <br /> unsuspended civil penalty. <br /> The Division believes this is a violation of: <br /> • C.R.S. 34-32.5-124 for failure to comply with the conditions of an order, permit, or regulation. <br /> Therefore,the Division has reason to believe that a violation exists to the Colorado Land Reclamation Act for <br /> the Extraction of Construction Materials, C.R.S. § 34-32.5-101 et seg., and the provisions of your Permit No. <br /> M-2003-002, and has scheduled this matter to appear before the Board. <br /> A Formal Public Hearing will be held during the August 17-18, 2022 Board meeting for consideration of the <br /> possible violation. Due to the impacts of the COVID-19 pandemic on the availability of State facilities and <br /> Division resources, notice is hereby given that the this Board hearing will be held by a virtual ZOOM hearing. <br /> All exhibits and materials you wish for the Board to consider related to this alleged violation must be <br /> submitted via email to the Board administrator, Camie Mojar at Camille.Moiar@state.co.us no later than <br /> 5:00 p.m. on August 5, 2022.
