The Colorado Division of <br /> Reclamation,Mining and Safety has completed its preliminary review of the above referenced report. <br /> Please see the Division's findings below regarding the report's compliance with the following Rules. <br /> o Rule 2.04.13(1)—The 2021 ARR is dated 1 April 2022 and the Division received an electronic <br /> copy of the report on that date. <br /> a. The name and address of the permittee is on the report form. <br /> b. For the reporting year zero acres of lands were placed in the Acres Disturbed Category <br /> comprising backfill/grading,long term facilities and active mining areas. Active mining <br /> is not occurring at the site,and reclamation activities have been completed as permitted. <br /> Outstanding acres awaiting Phase I bond release comprise approximately 106.2 acres. <br /> c. For the reporting year,zero acres were reported to have been backfilled or graded. <br /> d. For the reporting year,no seeding of affected lands occurred in the 9 years and less <br /> category. <br /> e. A total of zero acres where phase I bond released in 2021. <br /> f. Phase II bond released acres comprised 379.5 acres in 2021. <br /> g. Phase III bond released acres comprised 1183.6 acres in 2021. <br /> h. The operator conducted weed control activities throughout the site as summarized in the <br /> submitted weed spray logs for 2021. <br /> i. The values for total acres disturbed,backfilling and grading and permanent facilities for <br /> 2021 do not reconcile. backfilling and grading,active mining and acres in permanent <br /> facilities should equal total acres disturbed. <br /> April 2021 DRMS Adequacy/Discrepancies <br /> DRMS 21 June 2022 <br /> Numbers from 2020 form coincide with 2021 form and there appears to be a discrepancy as stated in <br /> section i. above <br /> 1. Please supply DRMS with a map depicting acreage in long term facilities. Please clarify and <br /> revise the 2021 annual reclamation report form accordingly by 15 July 2022. <br /> 2.
