Box 25486, DFC (MS 65412) <br />Denver, CO 80225-0486 <br /> <br /> <br />Re: New Elk Mine (Permit No. C-1981-012) <br /> Technical Revision No. 76 (TR-76) <br /> Proposed new haul road. <br /> <br /> <br />Dear Sir or Madam: <br /> <br />The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34, <br />Article 33, Section 116, Paragraph 4, of the Colorado Revised Statutes, that on June 21, 2022 an <br />application to revise coal mining operations at the New Elk Mine was considered complete for the <br />purposes of filing. The revision was submitted by New Elk Coal Company, LLC. All review and <br />comment periods as provided in the Act and the Regulations initiate from this date of filing. <br /> <br />This revision (TR76) proposes to change a currently approved light use road to a haul road and <br />extends the haul road for a total length of about 2.7 miles. This permit boundary extension represents <br />11.3 acres and the proposed additional affected area was historically disturbed in the former railroad <br />bed (including side slopes, culverts, and access trails). The disturbed area is the running surface of <br />the new road (along with berms or other areas of disturbance associated with construction of the <br />road) that represents 6.4 acres (see proposed Map 1 and Map 15a). The applicant is proposing <br />additional surface disturbance outside of the area currently approved for disturbance. <br /> <br />The underground coal mining operation is on land located approximately 25 miles West of Trinidad, <br />Colorado. The permit area is further described as follows: <br /> <br />Township 33 South, Range 68 West, in sections 13, 14, 21, 22, 23, 24, 25, 26, and 27. A reclaimed <br />vent shaft is located in Township 33 South, Range 67 West, in Section 19. These sections can be <br />located on the USGS 7.5 minute Vigil and Weston quadrangle maps. The Jansen Loadout is also <br />part of Permit C-1981-012 and is approximately 2 miles west of Trinidad, Colorado in Township 33
