Two Rivers Sand, Gravel and Reservoir Project Notice To Adjacent Surface Owner of Record To Whom It May Concern: In reference to the Two Rivers Sand, Gravel and Reservoir Project covering Varra Companies' (the "Applicant") proposed Regular Impact (112) Construction Materials Operation Reclamation Permit Application ("Application") covering the captioned lands shown on Applicant's Exhibit C-1: Existing Conditions Map ("Property"), PDC Energy, Inc., as an owner of existing oil and gas development structures within the Property and oil and gas leasehold interests on the Property, has interest in maintaining the current surface conditions of the Property to avoid damage and/or loss of access to our infrastructure within or interference with our ability to develop and/or produce from our oil and gas leasehold interests. PDC is attempting discussions with the Applicant but, to date, has not yet developed or finalized an agreement with the Applicant. PDC respectfully requests assurance from the Colorado Division of Reclamation, Mining and Safety that this project will not cause harm or interruption to our operations on the Property. Until this matter is resolved by agreement with the Applicant, PDC objects to the Application and, absent an agreement, PDC is not waiving and hereby reserves its rights as a leasehold mineral rights owner with respect to the Property. Any approval of the proposed application must be conditioned upon the preservation of PDC's rights in the Property. PDC respectfully requests that this objection be entered into the record for the proposed Application and that we continue to be provided with advanced notice of all other hearings affecting the Property and Application.
