Box 33695 <br /> Denver, CO 80233-0695 <br /> Re: <br /> Dear Mr. Tennyson; <br /> You informed me recently that a portion of the New Horizon Mine, C 1981008,was in the process of <br /> a change in surface land ownership. You asked the Division to confirm which rules apply to changes <br /> in property ownership. ERMR will need to update Section 2.03.4 of the permit once the ownership <br /> change is final. I am including the rules which apply to property ownership; <br /> 2.03.4(6)(c) [Each permit application shall contain the names and addresses of.] <br /> Any purchaser of record under a real estate contract of the property to be mined by surface coal <br /> mining activities or for underground mining activities, areas affected by facilities incidental <br /> thereto, and any purchaser of record under a real estate contract of the coal to be mined; <br /> 2.03.4(9) Each application shall contain a statement of all lands, interests in lands, options, or <br /> pending bids on interests held or made by the applicant for lands which are contiguous to the <br /> area to be covered by the permit. Information required by this paragraph may be considered <br /> confidential for purposes of these rules if the requirements of 2.07.5 are met. <br /> 2.03.6 Right of Entry and Operation Information <br /> (1) Each application shall contain a complete and detailed legal description of the <br /> proposed permit boundary, a description of the documents upon which the applicant <br /> bases his or her legal right to enter and begin surface coal mining operations in the permit <br /> area, and a statement as to whether that right is the subject of pending litigation.
