BEFORE THE MINED LAND RECLAMATION BOARD <br /> STATE OF COLORADO <br /> FINDINGS OF FACT, CONCLUSIONS OF LAW,AND ORDER <br /> IN THE MATTER OF THE NOTICE OF HOURGLASS SANDS, LLC OF A <br /> FIRST PERIOD OF TEMPORARY CESSATION, File No. M-2006-017 <br /> THIS MATTER came before the Mined Land Reclamation Board ("Board") as a <br /> consent item on April 20, 2022, via videoconference to consider the notice of a first <br /> period of temporary cessation filed by Hourglass Sands, LLC ("Operator"), file <br /> number M-2006-017 ("permit"). <br /> The Board, having considered the materials presented with this consent <br /> agenda item and having been otherwise fully informed of the facts in the matter, <br /> enters the following: <br /> FINDINGS OF FACT <br /> 1. Operator holds a 112(c) reclamation permit for a sand operation. The <br /> site is known as the Jemadojin Sand Mine. The site is located in El Paso County, <br /> Township 16 South, Range 62 West, Section 34, 6th Principal Meridian. <br /> 2. On August 3, 2021, the Division conducted an inspection of the site. <br /> The inspection report, dated January, 24, 2022, noted that site was inactive and <br /> that mining ceased in February 2019. The inspection report noted inactivity as a <br /> problem and required that Operator either file a notice of temporary cessation, <br /> retroactive to February 28, 2019, or declare that the site was in final reclamation. <br /> 3. Operator submitted a Request for Temporary Cessation, dated <br /> February 18, 2022, to the Division. The notice stated that market conditions were <br /> the reason mining activities had ceased and that operations would resume when <br /> either the market made it feasible to resume mining or the mine is sold. <br /> 4. The Notice stated that temporary cessation began on February 2019. <br /> 5. Operator also committed to comply with all reclamation requirements <br /> or other activities related to applicable performance standards while the mine is in <br /> temporary cessation. <br /> 6. The financial warranty is adequate to cover current reclamation. <br />
