NAD83) <br /> Easting: 186119.0 Northing: 4333437.0 <br /> PERMIT TO EXPOSE WATER IN A EXISTING PIT <br /> ISSUANCE OF THIS PERMIT DOES NOT CONFER A WATER RIGKF <br /> CONDITIONS OF APPROVAL <br /> 1 This we((shaft be used in such a way as to cause no material injury to existing water rights.The issuance of this permit does not <br /> ensure that no injury will occur to another vested water right or preclude another owner of a vested water right from seeking <br /> relief in a civil court action. <br /> 2) Pursuant to Rule 3.2 of the Rules and Regulations for Water Wet(Construction, Pump Installation,Cistern Installation,and <br /> Monitoring and Observation Hote/Well Construction 2 CCR 402-2,these rules do not apply to excavations made for the purpose <br /> of obtaining or prospecting for minerals or to those wells subject to the jurisdiction of the Mined Land Reclamation Board,The <br /> construction of this well shall be in compliance with alt applicable municipal,county,state,and federal regulations and <br /> standards.The well or hole must be constructed to prevent contamination of surface or ground water. <br /> 3) Approved pursuant to CRS 37.90-137(2)to replace well permit no. 57389-F, for the operation of an existing wett(gravel pit <br /> pond)exposing and diverting ground water tributary to the Colorado River at a point where water is available for appropriation. <br /> This well is known as the 23 Road Pit, Division of Reclamation,Mining ri Safety Permit Number M-1979-089. <br /> 4) The issuance of this permit hereby cancels welt permit no. 57389-F. <br /> 5) The approval of this permit does not grant a water right.This well(gravel pit pond)is subject to administration by the Division <br /> Engineer in accordance with applicable decrees,statutes, rules and regulations. <br /> 6) The average annual,amount of ground water to be appropriated shalt not exceed 316.26 acre-feet for the uses described below <br /> excluding dewatering, with the total surface area of the proposed ground water pond limited to 50 acres. <br /> 7) The use of ground water, in addition to evaporation, is limited to dewatering(1,200 GPM),evaporation, dust control, product <br /> moisture toss,and aggregate washing. No other use of water is allowed unless a permit therefore is approved. <br /> 8) The owner shall mark the well(gravel pit pond)in a conspicuous place with well permit number(s)and court case number(s)as <br /> appropriate. The owner shall take necessary means and precautions to preserve these markings. <br /> 9) A totalizing flow meter must be installed so as to measure any pumping from this gravel pit pond and maintained in good <br /> working order. Permanent records of all diversions from the gravel pit pond, tonage of mined product, and the surface area of <br /> ground water exposure shall be maintained by the wet(owner(recorded at least annually)and submitted to the Division <br /> Engineer upon request. <br /> 10) Pursuant to Rule 9.3.3 of the Water Well Construction Rules, ground water ponds and gravel pit wells are exempt from the <br /> minimum wet(construction and location standards except for contamination considerations as stated in the Rule.The owner <br /> shalt take necessary means and precautions to prevent contaminants from entering the ground water pond or gravel pit well. <br /> 11) Pursuant to Rule 17.1.5 of the Water Weil Construction Rules,the following were received:site plan and cross section drawings <br /> showing the extent of intended excavation, the maximum depth of the pit or pond, the initial static water level,and the date <br /> of initial ground water exposure to the atmosphere. <br /> 12) The boundaries of the gravel pit pond shall be more than 600 feet from any existing wet(, completed in the same aquifer, that is <br /> not owned by the applicant.Waivers were received from the owners of well permit nos. 36276-F,41478-F,and an unregistered <br /> pit well. <br /> NOTE:This wet(may be subject to administration in the water rights priority system in the future.
