Thence N00°23'01"E along the West boundary of said NW1/4 and said Tracts 4-5 a <br />distance of 825.90 feet to the point of beginning. Said tract containing 8.13 acres more or <br />less. <br />Including the right and privilege of exploring and prospecting for, developing, and mining <br />of and taking of sand and gravel minerals from the above described property, together with <br />the right to use as much of the surface as may be reasonably required, including the right <br />to reasonable ingress and egress, the right to make excavations, stockpiles and other <br />improvements as may be reasonably necessary in the mining and removal of said minerals; <br />subject, however, to all existing easements and rights -of -way of third parties, if any, and <br />further subject to the terms, conditions and agreements set out in this Lease. <br />See also Exhibit 1 Proposed Pit Plan and Exhibit 2 Recorded plat <br />(the foregoing all being the "Leased Premises"): <br />2. RENT. The Lessee shall pay to the Lessor rent in the amount of One Thousand Five <br />Hundred Dollars ($1,500.00) per year for every year during the term of this Lease or any <br />extension thereof as may be contemplated hereunder. Initial rent shall be payable on the <br />date of receipt by Lessee of its mining permit from the State of Colorado, and thereafter be <br />paid in annual installments on the anniversary thereof. The rent shall be payable to Lessor <br />at the address set out in the initial paragraph ot this Lease or at such other place as may be <br />designated by the Lessor writing. <br />3. PRODUCTION ROYALTY. Lessor reserves and requires as royalty payment of $0.45 per <br />ton of sand and gravel produced and sold from the Leased Premises. Lessee agrees to pay <br />said royalty to Lessor on the last day of each calendar month of production. Further at the <br />end of each Term, for so long as this lease remains in effect, the Parties may renegotiate <br />and fix and determine the rate of production royalty to be paid during each year of the <br />succeeding Term. <br />4. TERM. The initial term of this Lease shall commence on the date of receipt by Lessee of <br />its mining permit from the State of Colorado and continue for a period of Ten (10) years. <br />5. LEASE EXTENSION. Lessee shall have a preferential right to renew the Lease or to <br />receive a new Lease, whichever may be determined by Lessor, under the following <br />conditions: <br />a. Lessee shall furnish to Lessor satisfactory evidence of plans for mining during <br />the term of the renewed lease or during the term of a new lease. <br />b. Lessee shall furnish adequate geological evidence to Lessor that the acreage <br />subject to the renewed or new lease is in fact an integral part of and contains <br />reserves in a logical mining unit. Whether the acreage is or is not part of a <br />logical mining unit will be determined by Lessor. <br />c.
