Dowe Flats Special Use Permit Amendment Application May 2, 2022 <br /> 7. The use will support a multimodal transportation system and not result in significant <br /> negative impacts to the transportation system or traffic hazards. <br /> Continued mining operations at Dowe Flats through this SUP application will not generate new <br /> traffic. The traffic generated by the operation of the site is so insignificant that County staff <br /> determined that a new traffic impact study was not needed for this application. Copies of the <br /> PAMS report prepared by Felsburg, Holt & Ullevig traffic consultants and email correspondence <br /> from County staff approving the PAMS report are included in this application package. <br /> 8. The use will not cause significant air, odor, water or noise pollution. <br /> Continued mining at Dowe Flats will not result in any significant air, odor, water, or noise <br /> pollution. The site successfully operates in accordance with its existing Air Pollution Emissions <br /> Notice (APEN) and Storm Water Permit and associated stormwater management plan, all of <br /> which were issued by the State of Colorado Department of Public Health and Environment <br /> (CDPHE). The site does not generate odors. Noise is effectively controlled because the activity <br /> is contained within the mining cell where the walls of the cell and earthen berms constructed <br /> around the site absorb noise that is generated. In addition, the processing equipment on the <br /> site is enclosed to further minimize the creation of noise impacts. There is no history of <br /> violations or compatibility-related complaints associated with Dowe Flats. <br /> 9. The use will be adequately buffered or screened to mitigate any undue visual impacts of <br /> the use. <br /> The existing vegetated berm successfully screens views into Dowe Flats from adjacent public <br /> roads (Highway 66 and North 53rd Street). There have been no complaints about visual impacts <br /> and because the site will continue to operate as it has historically, no new visual impacts will be <br /> created. <br /> 10. The use will not otherwise be detrimental to the health, safety, or welfare of the present <br /> or future inhabitants of Boulder County. <br /> The use proposed in this SUP will not be detrimental to the health, safety, or welfare of the <br /> present or future inhabitants of Boulder County. The Dowe Flats facility has operated since <br /> 1993, and the plan is for the facility to continue to operate as it has historically: in a manner that <br /> is protective of the health, safety, and welfare of the inhabitants of the County, including: <br /> • Transporting all material from Dowe Flats to the CEMEX, Inc. cement plant via covered, <br /> electric conveyor rather than haul truck. <br /> • Operating under an APEN permit issued by the CDPHE. <br /> • Operating in accordance with Mine Safety and Health Administration (MSHA) <br /> requirements. <br /> • Hiring a blasting contractor, Buckley Powder, a Colorado company with a good safety <br /> record that is properly permitted through the Bureau of Alcohol, Tobacco, Firearms and <br /> Explosives (ATF). <br /> • Maintaining a stringent health and safety program and protocols for all CEMEX, Inc. <br /> employees and contractors. <br /> 11. The use will establish an appropriate balance between current and future economic, <br /> environmental, and societal needs by minimizing the consumption and inefficient use of <br /> energy, materials, minerals, water, land, and other finite resources. <br /> Continued mining at Dowe Flats will create a balance between current and future economic, <br /> environmental, and societal needs of Boulder County by minimizing the consumption and <br /> inefficient use of energy, materials, minerals, and land. <br /> Review Criteria Statement- Page 9 O TETRA TECH <br />
