Box 11235 <br /> Prescott, AZ 86304 <br /> RE: WRC Wet Pit, Permit M-2014-063, Incomplete Application for Transfer of Mineral Permit <br /> and Succession of Operators, Revision SO-1 <br /> Dear Mr. and Mrs. Brock: <br /> On May 2, 2022 the Division of Reclamation, Mining and Safety received the Application Form <br /> for Transfer of Mineral Permit and Succession of Operators from White River City Investments to <br /> Brian and Sheryl Brock, for the WRC Wet Pit, Permit M-2014-063. The following items are <br /> incomplete for the application to be processed: <br /> Application Form <br /> 1. A fee in the amount of $115 was provided. This is a construction materials permit, <br /> therefore the revision fee is $144. Please submit the remaining fee amount of$29. <br /> Legal Right to Enter <br /> 2. No documentation regarding legal right to enter was provided. Please provide <br /> documentation which demonstrates that the prospective operator has the basis for <br /> legal right of entry to the site and to conduct mining and reclamation. <br /> Structure Agreement <br /> 3. The Letter from Colorado Interstate Gas Company, LLC explicitly states that the land <br /> will not be used for mining. But that if excavations do occur a representative needs to <br /> be present if within 25 ft. of the pipeline. This letter does not constitute as structure <br /> agreement (damage compensation agreement). The prospective operator has not <br /> agreed to the conditions set by the pipeline company nor does this contract <br /> acknowledge that a mining operation may occur. A notarized document between the <br /> prospective operator and structure owner must be completed.
