<br />Dear Rio Blanco County Commissioners:
<br />
<br />The Division of Reclamation, Mining and Safety hereby issues notice, in accordance with Title 34,
<br />Article 33, Section 116, Paragraph 4, of the Colorado Revised Statutes, that on May 4, 2022 an
<br />application to revise coal mining operations at the Deserado Mine was considered complete for the
<br />purposes of filing. The revision was submitted by Blue Mountain Energy, Inc. All review and
<br />comment periods as provided in the Act and the Regulations initiate from this date of filing.
<br />
<br />TR-74 requests permission to combine current refuse pits RP-2/3/4 and 5A together into refuse pit
<br />RP-2/3/4/5. The applicant is proposing additional surface disturbance outside of the area currently
<br />approved for disturbance.
<br />
<br />The underground coal mining operation is on land located approximately 7 miles Northeast of
<br />Rangely, Colorado. The permit area is further described as follows:
<br />
<br />Portions of Sections 1, 2, 3, 4, 10, 11, and 12, T2N, R101W, 6th PM, all in Rio Blanco County;
<br />Portions of Sections 17, 18, 19, 20, 21, 23, 25, 26, 27, 28, 30, 31, 34, 35, and 36, T3N, R101W, 6th
<br />PM; All of Sections 22, 29, 32, and 33, T3N, R101W, 6th PM, all in Rio Blanco County.

<br />The above-mentioned tracts of land are shown on the following USGS 7.5 minute Quadrangle
<br />map(s): Rangely Ne.
<br />
<br />The applicant is required to publish notice in a local newspaper that this application has been
<br />deemed complete. At the time of publication of this notice, the applicant is additionally required to
<br />place a copy of this application at the Town Clerk, 209 East Main, Rangely, CO 81648. The
