or damage from any and all other causes. Any property of City damaged or destroyed by <br /> Entrant incident to the exercise of the privileges herein granted shall be promptly repaired <br /> or replaced by Entrant to a condition satisfactory to the City or at the election of the City, <br /> reimbursement made therefor by Entrant in an amount necessary to restore or replace the <br /> property to a condition satisfactory to the City. <br /> 12. INDEMNITY <br /> As between the Parties, and without either Grantor nor Grantee waiving any rights and <br /> protections provided under the Colorado Governmental Immunity Act ("CGIA"), C.R.S. <br /> 24-10-101 to 120, each Party will be responsible for its own negligence and that of its <br /> officers and employees in the performance of this Agreement.If either Party is given notice <br /> of a claim or suit against or involving the other arising from this Agreement, the Patty <br /> agrees to give the other Party prompt written notice of such claim or suit. Both Parties <br /> reserve the right to seek reimbursement for damages from any third party responsible for <br /> any damage. <br /> 13. RESTORATION <br /> On or before the expiration of this Agreement, Entrant shall vacate the Premises,remove <br /> the equipment of Entrant and restore the Premises to a condition satisfactory to the City. <br /> If Entrant shall fail or neglect to remove said equipment and restore the Premises,then,at <br /> the option of the City, the property shall either become the property of the City without <br /> compensation therefor,or the City may cause the property to be removed and no claim for <br /> damages against the City or its officers or agents shall be created by or made on account <br /> of such removal and restoration work. Entrant shall also pay the City on demand any sum <br /> which may be expended by the City after the expiration,revocation,or termination of this <br /> Agreement in restoring the Premises. Entrant shall provide coordination of any possible <br /> public hazards warranting extra protection during the remediadon process. <br />
