Requirement Regulation Comment <br /> K. Basic Standards CWQCC Surface water sites PRS 1 and PRS 4 are monitored semiannualy <br /> for Surface Water Regulation 31 see section L below: Instream Numeric Standards. <br /> New Elk Mine is subject to the water quality standards on <br /> the Arkansas River Basin, Segment 5b for the Middle Fork <br /> of the Purgatoire River. <br /> L. Instream New Elk Mine's discharges from NPDES outfalls are based <br /> Numeric CWQCC on constituents in its effluent likely to cause an <br /> Standards Regulations 32 exceedence of numeric standards. Discharges in 2019 <br /> and 2020 appeared to comply with discharge limitations <br /> set as per the NPDES permit. It is reasonable to conclude <br /> that New Elk Mine's discharges did not violate Segment <br /> 5b for the Middle Fork of the Purgatoire River instream <br /> numeric standards. <br /> Upon completion of mining,New Elk's pond network will be <br /> M. Prevention of reclaimed as they do not hold consistent water throughout the <br /> impacts to year.
