RULE 2 PERMITS <br /> In regard to the unleased BLM surface and mineral estates included within the permit boundary, <br /> no mining or exploration activities will take place on these lands without obtaining the appropriate <br /> BLM lease, license, or permits. In June 2004, Colowyo inadvertently extracted 2600 tons of <br /> unleased federal coal in SW 1/4 of Sec.4, T3N, R93W, 61h PM. <br /> A detailed description of the Permit boundary is contained within Volume 16, Exhibit 1, Item 13. <br /> 2.03.7 Relationship to Areas Designated Unsuitable For Mining <br /> The permit area is not within an area designated unsuitable for surface mining activities as defined <br /> in Rule 7 or 30 CFR 764 and 765 or under study for designation in an administrative proceeding <br /> under Rule 7 or 30 CFR 764 and 765. <br /> 2.03.8 Permit Term Information <br /> Colowyo has submitted information within this application to cover the entire life-of-mine area, <br /> including the next five year permit term. The anticipated timetable for each phase of mining and <br /> reclamation and the anticipated number of acres to be affected are shown on Map 23A and 23B <br /> and Table 2.03-1, Affected Areas for Mining and Reclamation. <br /> 2.03.9 Personal Injury and Property Damage Insurance Information <br /> The certificate certifying that Colowyo has a public liability insurance policy in force for the <br /> surface coal mining and reclamation operation is set forth as Volume 2A, Exhibit 3, Certificate of <br /> Insurance. <br /> 2.03.10 Identification of Other Licenses and Permits <br /> The following is a list of permits and licenses covering the Colowyo surface coal mining <br /> operation: <br /> Colowyo - Facility Wide Air Permit No. 95MF 1040 (issued 10/25/17) and 16MF 1324F <br /> (issued 6/22/18) <br /> Colorado Department of Public Health and Environment <br /> Air Pollution Control Division <br /> 4300 Cherry Creek Drive South <br /> Denver, CO 80220-1530 <br /> Colorado Department of Public Safety (CDPS) Wastewater Discharge Permit no.
