C2010089 RN2 Adequacy No. 2
March 29,2022
to apply for phase I bond release for this area for the Division to be able to release the liability for the
structures and reclamation of the facilities area. Reclamation liability costs for demolition of structures
and reclamation of the facilities were retained in the reclamation cost estimate after approval of SL2.
SL3 is currently under review by the Division, but these items were not included within the SL3 bond
release request application. ERMR updated the facilities map;Map 2.05.3(3)-1 with MR28, showing the
approved permanent structures remaining at the facilities area. No liability costs were released with the
approval of MR28. Task 95 for demolition and removal of all structures remains in the RN2 reclamation
cost estimate. Structures that have been approved to remain as permanent have been removed from the
demolition task.
The Division has had other operator request credit for removal of structures, prior to completion of back
fill and grading operations on the structure footprint areas at other mine sites. The Division has been
unable to allow for credit of structural removal without an operator applying for Phase I bond release after
having completed the required backfill and grading operations. I am including additional letters regarding
these decisions as attachments to this letter.
Sincerely,
Janet H. Binns
Environmental Protection Specialist III
Janet.binnskstate.co.us
Attachments: Utah action plan 5/3/2017,Letter from OSMRE,dated 1/9/1991, regarding Colorado bond
reduction.
