Summary <br /> The Review Process <br /> The Division notified CEC on February 1, 2021 that the existing permit for the Keenesburg Strip <br /> Mine would expire on November 3, 2021. CEC responded on May 7, 2021 with an application <br /> for permit renewal. The Division deemed the application complete on May 17, 2021. <br /> Public notice of submittal of the application was published four times in The Fort Lupton Press <br /> between July 28, 2021 and August 25, 2021. Notice that the application was considered <br /> complete for the purposes of filing was provided by the Division, in accordance with Title 34, <br /> Article 33, Section 118, Paragraph 3, of the Colorado Revised Statutes. <br /> The application was reviewed for adequacy, and the Division identified seven items requiring <br /> update or clarification in a letter to CEC (dated July 14, 2021). CEC provided acceptable <br /> responses to all items. <br /> There are no stipulations on this permit at this time. Stipulations I through 4, 6 through 16, and <br /> 18 of the original permit were resolved during the first five-year permit term. Stipulations 19, 22 <br /> and 27 were resolved during the second five-year permit term. Stipulations 5, 17, 20, 21, 23, 24, <br /> 25, 26, 28, 29, 30, 31 were resolved during the third five-year permit term. <br /> The Applicant Violator System (AVS) finding of February 18, 2022 and April 14, 2022 was"no <br /> violations." <br /> Description of the Environment <br /> The Keenesburg Strip Mine is located approximately five miles north of Keenesburg Colorado. <br /> The legal description of the permit area is presented above in the Introduction. The site is <br /> located on the USGS 7.5-minute Quadrangles Klug Ranch and Tampa. In the PAP, Appendixes <br /> A-1, A-2, and A-3 show the permit boundary, land owners, and additional information. <br /> Per the RN-08 Application, there are 225.55 acres remaining in the permit area, with <br /> approximately 215.29 acres of approved disturbed area. As a surface mine, the Keenesburg Strip <br /> Mine's approved affected acreage equals its approved disturbed acreage. According to the 2021 <br /> Annual Reclamation Report, approximately 444 acres have been disturbed over the life of the <br /> mine with approximately 264 acres approved for Phase III bond release. <br /> Currently, there is no coal extraction activity at the site and none is anticipated. The open pits <br /> were backfilled with mine waste rock and ash imported from the Trigen Colorado Steam and <br /> Electric Plant in Golden, Colorado. The pits were reclaimed in accordance with the reclamation <br /> plan described in the PAP. Ash importation ceased in April 2016. During active coal extraction, <br /> the Number 7 seam of the Laramie formation was mined. <br /> 4 <br />
