Section 6.4.19 EXHIBIT S(a) provide a notarized agreement between the applicant and <br /> the person(s)having an interest in the structure, that the applicant is to provide <br /> compensation for any damage to the structure;or <br /> Section 6.4.19 EXHIBIT S (b) where such an agreement cannot be reached, the <br /> applicant shall provide an appropriate engineering evaluation that demonstrates that <br /> such structure shall not be damaged by activities occurring at the mining operation;or <br /> Section 6.4.19 EXHIBIT S (c) where such structure is a utility, the Applicant may supply <br /> a notarized letter, on utility letterhead,from the owner(s)of the utility that the mining <br /> and reclamation activities, as proposed, will have "no negative effect"on their utility." <br /> 2.0 Background <br /> CJK Milling Company-Specialty Aggregates (GK-Slag) is located approximately two and one half <br /> (2.5) miles southwest of Leadvilte (See Figure 1-General Location map). The slag aggregate <br /> parcel is zoned Industrial/Mining and is approximately ninety-two (92) acres of which fifty-six <br /> (56) acres will be affected by remedial operations. The slag to be mined was created in the <br /> early 1900's and remain as un-reclaimed smelter waste. CJK-Slag has a pending mining permit <br /> requesting authorization to crush, screen and use the aggregate material for multiple <br /> commercial uses. <br /> Property within two hundred (200)feet of CJK-Slag includes undeveloped patented mine <br /> properties, a reclaimed Colorado Zinc Lead tailings pond, Leadville Sanitation (fence, water and <br /> sewer pipelines, polishing pond, concrete vault), an unpaved access road to a commercial solid <br /> waste facility (Orin Diedrich), Xcel Energy and CDOT-Highway 24 (See CJK-Slag base map Figure <br /> 2).
