Recitals. Subject to all of the terxns and conditions set forth in this Agreement,the Parties <br /> agree to the following: <br /> A. For the benefit of Nancy Lynn Ranch,the"Contractor's will perform permitting <br /> mining, cnishing, cultivating and reclamation activities as would normally be <br /> conducted in the course of rock mining. <br /> B. For the benefit of Nancy Lynn Ranch,Contractor's will perform surveying and <br /> mapping activities to support any and all permits held by Bower Brothers <br /> Construction, Inc as they relate to the Property as defined below ("Mapping <br /> Work"); <br /> C. In return for the Mapping Work,Nancy Lynn Ranch will permit Contractor's <br /> the right to enter the Property; <br /> D. The primary role of the Contractor's will be to sell rock, aggregate, sand and <br /> gravel as the Mining Work is completed; <br /> E. The Mining Work and Mapping Work shall be performed in a good and <br /> workmanlike manner and in compliance with all applicable federal, state and <br /> local laws,ordinances,regulations,codes and orders. <br /> 2. Propertv.The Gravel to be cultivated and removed through execution of the Mapping Work <br /> and Mining Work is located at a pit upon the follawing real property situate in Moffat <br /> County,Colorado: <br /> Township 6 North,Range 95 West of the 6`�'Principal Meridian: <br /> Section l: S1/2 <br /> Section 7: Wl/2 ofthe NWl/4 <br /> Section 12:Nl/2 <br /> Permit No.M-2013-006 descnbed as a 9.99 acre limestone pit("Taylor Pit"}plus a 20 acre <br /> expansion to the current permit�ea. <br /> Permit No.M-1981-276 described as a 80 acre permit(Hertrog PiY') <br /> Use of Property by the Parties: The primary role of the contractors will be to own and <br /> maintain any mining permits necessary for the uses described here in.The primary role of <br /> Contractor's will be to control the mining and reclamation activities on the Property. <br /> Contractar's shall have the right to enter the properiy to mine and crush the Gravel and <br /> Limestone. Contractor's will also undertake to complete any mapping and surveying <br /> needed to support all permits inclusive of tbe Division of Reclamation,Mining and Safety <br /> permit held by Bower Brothers Construction,Inc.Nancy Lyim Ranch,will have the right <br /> to enter the groperty as the exclusive owner of the commodities ihat are pro�uceQ on ihe <br /> Se�rices Agreem�t <br /> Page 1 of2 <br />
