The required fee of $257.00 for an SWSP renewal has been <br /> submitted (receipt no. 10018551). The Applicant shall be responsible for compliance with this SWSP, but <br /> the State Engineer's Office ("SEO") may also pursue the landowner for eventual compliance. <br /> SWSP Operations <br /> The Inouye Pit is located near the northwest edge of Fort Lupton in the N'h of the SW'/4 of Section 31, <br /> Township 2 North, Range 66 West, 61h P.M. and the E'h of the SE 1/4, Section 36, Township 2 North, Range <br /> 67 West, 61h P.M. This SWSP renewal seeks to replace depletions resulting from the mining operation <br /> following the first two years of operation, including evaporation from exposed groundwater, dust <br /> suppression, past dewatering, water lost with the mined product, and water used for slurry construction. <br /> Though the slurry wall is anticipated to be constructed in 2022, the Applicant conservatively anticipates <br /> that approval of the liner may not be completed during the SWSP period. Approximately 750,000 tons are <br /> to be excavated from the pit each year. The proposed reclamation of the site is a lined reservoir through <br /> the construction of a slurry wall around the mining area. The proposed replacement of depletions for this <br /> site during the period of this SWSP will be leased water from the Central Colorado Water Conservancy <br /> District ("CCWCD"). <br /> In accordance with the letter dated April 30, 2010 (copy attached) from the Colorado Division of <br /> Reclamation, Mining, and Safety ("DRMS"), all sand and gravel mining operators must comply with the <br /> requirements of the Colorado Reclamation Act and the Mineral Rules and Regulations for the protection <br /> of water resources. The April 30, 2010 letter from DRMS requires that you provide information to <br /> DRMS to demonstrate you can replace long term injurious stream depletions that result from mining <br /> related exposure of groundwater.
