PERMIT#: M-1977-151 <br /> INSPECTOR'S INITIALS: ECS <br /> INSPECTION DATE:March 15,2022 <br /> area of post 1981 groundwater exposure to 2 feet above static water level. Lining of the existing ponds using <br /> clay liners or a slurry wall to isolate them from the aquifer is also an option, however the permittee will need to <br /> determine if this option is feasible. <br /> If the provided technical revision contains plans to backfill any of the existing post 1981 groundwater exposure, <br /> (the current SWSP renewal request states that approximately 8.25 acres of post 1981 surface area would need <br /> to be backfilled to address shortfalls with the currently held water rights) the revision must specify, at a <br /> minimum, what areas will be backfilled, approximately how many cubic yards of material will be required, and <br /> where that material will be obtained from. The revision should also provide a timeline for completion of any <br /> earthwork still required at the site such as backfill or shoreline sloping. <br /> The Division will use the information contained in the provided technical revision to determine the appropriate <br /> surety increase for the site to address the existing liability due to exposed groundwater, then send a separate <br /> surety increase notice to the operator detailing the required increase of the financial warranty. The operator <br /> will have 60 days from the date on the surety increase notice to post the additional financial warranty. <br /> CORRECTIVE ACTION DUE DATE: 5/31/22 <br /> INSPECTION TOPIC: Gen. Compliance With Mine/Reclamation Plan <br /> PROBLEM/POSSIBLE VIOLATION: Problem:The current mining and reclamation plans (unmodified since 1977) <br /> need to be updated and clarified pursuant to C.R.S. 34-32.5-112 (1)(c)(VI). This is especially true for the <br /> currently unmined area located west of N 23rd Ave. where significant non-mining related activities are <br /> occurring. <br /> The operator must provide sufficient information to describe or identify how the operator intends to conduct <br /> any additional mining at this site. In addition, as stated above,the reclamation plan needs to be updated and <br /> clarified pursuant to C.R.S. 34-32.5-116 (1) to provide sufficient information to describe or identify how the <br /> operator intends to conduct final reclamation. <br /> CORRECTIVE ACTIONS:The operator shall submit a partial release request, and/or technical revision, as <br /> appropriate, with all required fees,to update and clarify the current mining and reclamation plan to reflect <br /> existing and proposed activities by the corrective action date. <br /> CORRECTIVE ACTION DUE DATE: 5/31/22 <br /> OBSERVATIONS <br /> This was an inspection conducted by Eric Scott representing the Division of Reclamation Mining and Safety <br /> (DRMS) as part of the Division's routine monitoring program. The site was last inspected by DRMS on <br /> November 1, 2017. This site identification sign was present and the permit area is defined by existing fences. <br /> No mining activity was observed during the inspection, and mining does not appear to have taken place at this <br /> site in several years based on a review of available Google Earth photography. Mr. Hiner has continued to <br /> reclaim some shoreline areas. DRMS met with permittee Rex Hiner and his wife Sharon at their home within <br /> the permit area, and spent several hours with them discussing the issues noted in this report. These issues <br /> were also identified in the 2017 inspection, and have not yet been corrected. <br /> The general configuration of the site, and issues observed during this inspection, are largely unchanged from <br /> those noted in the 2013 and 2017 inspections. The most significant change noted was the expansion of non- <br /> mining activity, including a large gas and oil structure, in the northwestern unmined phase of the permit <br /> located west of N 23rd Ave, (see attached Sept 2021 Google Earth photo). <br /> Page 2 of 5 <br />
