..1'Z
IHC SCOTT
Q
RECEIVED
mAR 10 2022
DIVISION OF RECLAMATION,
March 10, 2022 MINING &SAFETY-MINERALS
Amy Yeldell
Environmental Protection Specialist
Colorado Division of Reclamation, Mining and Safety
1313 Sherman Street, Room 215
Denver CO 80203
Re: Decision Date Extension Request - Construction Materials Regular (112)
Operation Reclamation Permit, Application No. M-2021-052
Dear Ms. Yeldell,
This letter shall serve as IHC Scott, Inc.'s Decision Date Extension Request regarding
the above-referenced application. Our goal was to submit both the Amended DRMS
application and Garfield County Land Use Change Permit application by March 11, 2022,
but given your directive to request a decision date extension, we will submit that
request first. Accordingly, our requested new decision date is April 29, 2022.
Pursuant to the inquiry in your email of March 9, 2022, IHC Scott and its engineering
consultants have completed the following since January 1, 2022:
Completed redesign of mining plan to implement a wet mining methodology.
Full wetland delineation of the Rifle Pit property and creation of a comprehensive
wetland study map.
Consultation with USACE representatives to confirm the new mining plan will
allow us to avoid a 404 nexus and corresponding permitting.
Pre-application meeting with Garfield County Community Development to review
the revised mining plan and related change and ensure those changes will satisfy
their requirements as stated in 2021.
Should you have any questions or need additional information, please do not hesitate
to contact me directly at 720-490-7407 or churley@ihcscott.com.
Sincerely,
I OTT,
Chris Hurley
Corporate Counsel
An Equal Opportunity Employer
