As the City of Colorado Springs owns the property in question, I reached out to you via <br />telephone, and on February 24, 2022 you agreed to complete an “Is It Mining” questionnaire in order <br />for the Division to determine whether a mine reclamation permit is required for this property. A <br />copy of the questionnaire was emailed to you on February 24th and to date the Division has not <br />received a response. <br />The Division has specific Rules and Regulations for the Extraction of Construction Materials, <br />adopted by the Colorado Mined Land Reclamation Board in August 2006. These rules are in <br />accordance with the Colorado Land Reclamation Act for the Extraction of Construction Materials <br />(Title 34 Article 32.5). <br />As defined in the Act (34-32.5-103(13)), “mining operation” means the development or extraction <br />of a construction material from its natural occurrences on affected land. The term includes, but is <br />not limited to, open mining and surface operation. The term also includes transportation and <br />processing operations on affected land. These activities would need an approved mine reclamation <br />permit with the Division. <br />As defined in the Act (34-32.5-110), Any person desiring to conduct mining operations, prior to <br />commencement of mining, shall file with the office, on a form approved by the board, an <br />application for a permit to conduct mining operations.
