COLORADO <br /> \/ Division of Reclamation, <br /> ® Mining and Safety <br /> Department of Natural Resources <br /> Mr.Fred Lundy <br /> Lincoln County Land Use <br /> P.O.Box 39 <br /> Hugo CO 80821 <br /> 28 February 2022 <br /> Re: Dougherty Pit, Permit M1978079 <br /> DRMS Adequacy Review of Responses to adequacy questions Permit Conversion CN1 <br /> Dear Mr. Lundy: <br /> The Division has completed its response to the preliminary adequacy questions posed on review of the <br /> Dougherty Pit conversion application. <br /> The permitting action comprises a change of permit type from a Limited Impact Permit(110c),to a <br /> Reclamation Permit(112c),with an addition of 10 acres creating a total permit area of 19.87 acres. <br /> The revision was received by the Division on 4 April 2021. The revision was considered filed for <br /> review on 16 April 2021 with the completeness determination. Preliminary adequacy questions were sent <br /> 1 June 2021 and secondary adequacy was sent by DRMS on 23 June 2021. A request for extension to 23 <br /> August 2021 was submitted to DRMS on 24 June 2021. A second extension request to 22 November <br /> 2021 was received by DRMS on 20 August 2021.A third extension was requested on 12 November 2021 <br /> for 90 days,to a decision date of 13 February 2022. An extension request was received on 14 February <br /> with a decision date for 3 March 2022. Requested extensions were granted by DRMS. DRMS received <br /> the adequacy response from Lincoln County on 16 February 2022. <br /> Applicable rules of the Minerals Rules and Regulations of the Mined Land Reclamation Board for <br /> the Extraction of Construction Materials (referenced by Rule and number),and Article 32.5 of the <br /> Colorado Land Reclamation Act for the Extraction of Construction Materials (referenced by act <br /> section,Act were utilized in this review. The Division's review comprised the following: <br /> Rule 1.6.2, 3, 6.1, 6.2, 6.4 and Rule 6.5. <br /> DRMS 2022 February <br /> The required attachments submitted as Exhibits with the application were found to be adequate with <br /> the exception of items listed below according to associated Rules: <br /> Rule 6.4.5: Exhibit E Reclamation Plan as per Rule 3.1 <br /> DRMS notes thin topsoil(0-2 inches)will be salvaged and placed in a stockpile as per the submitted <br /> Mining Plan and replaced to a depth of 4 inches (Reclamation Plan). The original application <br /> suggested replacement to a 4 inch depth.
