PERMIT#:M-2021-059 <br /> INSPECTOR'S INITIALS:PSH <br /> INSPECTION DATE:December 16,2021 <br /> OBSERVATIONS <br /> This was a pre-operational inspection of the proposed Dunn Pit conducted by Peter Hays and Rob Zuber with <br /> the Division of Reclamation, Mining and Safety(Division/DRMS). Ms. Stephanie Fancher-English with Loveland <br /> Ready-Mix Concrete, Inc.was present during the inspection. <br /> The 112 construction materials permit application was received by the Division on September 13, 2021. The <br /> application was deemed complete on November 1, 2021. The Applicant published public notice as required by <br /> Rule 1.6.2(d)for four consecutive weeks. The last notice was published on November 24, 2021. The public <br /> comment period for the application ended on December 14, 2021. No letters of objection to the application <br /> were received by the Division during the public comment period. The notice sign was observed during the <br /> inspection as required by Rule 1.6.2(b). <br /> The Dunn Pit is a proposed 114.25 acre construction materials site with approximately 76 acres disturbed by <br /> mining excavation and approximately 38 acres for boundary offsets,the access road,the Big Thompson River <br /> corridor and stormwater management areas. The proposed mine site is currently used as pastureland for <br /> cattle grazing. The site is located approximately 1 mile northwest of Milliken, CO in Weld County. <br /> The mine site is proposed to be mined to bedrock utilizing an excavator to wet mine the site. The mining <br /> areas will not be dewatered during the mining activities. The mining activities are proposed in three (3) cells <br /> ranging in size from 11 to 36 acres. The mined slopes are proposed to be excavated at 1.5H:1V. The mined <br /> material will be stockpiled to allow the material to drain. The drained material will be transported off-site by <br /> trucks. No processing will occur at the site. The depth of the sand and gravel deposit ranges from 25 to 28 <br /> feet with 1 to 2 feet of topsoil above the deposit. The bedrock is weathered shale. A bridge crossing is <br /> planned to be constructed over the Big Thompson River to access the north side of the site. <br /> The proposed post-mining land use for the site is wildlife habitat with the construction of three (3) <br /> groundwater ponds. The construction of 2.55 acres of new wetlands during reclamation is possible. The <br /> Applicant has contacted the Army Corps of Engineers to discuss the need for a 404 permit. The disturbed <br /> areas above the waterline of the ponds will be topsoiled and revegetated with an upland seed mixture. A <br /> wetland seed mixture is also proposed to be used if the wetland areas are constructed by the Applicant. <br /> The proposed mine site was observed during the inspection. The site was observed from WCR 48.5 and the <br /> interior of the site was observed from the existing oil and gas road and by traveling off-road across the site. <br /> The site vegetation consisted of a pastureland with areas of well-established trees and grasses. Cattle were <br /> observed grazing the land during the inspection. All utilities along WCR 48.5 appear to have been identified by <br /> the Applicant. <br /> The Division's permit application adequacy review letter was sent to the Applicant on January 4, 2022. The <br /> current decision date for the application is March 1, 2022,following the approval of a decision date extension <br /> request from the Applicant on January 19, 2022. <br /> Photographs taken during the inspection are attached.
