The application <br /> was deemed complete on 15 February 2022. The decision date is set to 2 March 2022. No <br /> activities may occur at the site until the DRMS permit to conduct mining is granted. <br /> 6.3.4 Exhibit D Reclamation Plan <br /> 1. DRMS notes an acreage discrepancy between acres requested and reclamation acreage. The borrow pit is <br /> called out at 9.23 on the mine plan map and the permit application. The reclamation plan states that the <br /> disturbed are comprises an area of 414* 1013 feet translating to 9.63 acres. Please explain the <br /> discrepancy. The disturbed area must not be more than the requested permit acreage. <br /> 2. Fence called out as around the pit perimeter but only shown on west and south boundaries on mine plan <br /> map. <br /> 3. Is there adequate topsoil on site to replace topsoil to a 4-6 inch depth? <br /> 6.3.12 Exhibit L Structure Agreements <br /> The Applicant shall provide information sufficient to demonstrate that the stability of any structures <br /> located within two hundred (200)feet of the operation or affected land will not be adversely affected. <br /> A structure agreement for the Southeast Colorado Power Association was provided. The application <br /> stated that other structures are covered by existing lease and the CDOT construction contract. The <br /> lease makes no mention of having the leasee compensated for damages. DRMS is not certain that <br /> the CDOT contract has made a compensation agreement with the owners of any structures <br /> DRMS did not receive structures agreements for all structures. <br /> 4. Please provide structure agreement between Castle Rock Construction and all structure owners. Without <br /> structure agreements the application will be denied. <br /> This letter shall not be construed to mean there are no other technical deficiencies in your <br /> application. The Division will review your application to determine whether it is adequate to meet <br /> the requirements of the Act after submittal of all required items. <br /> Sincerely, <br /> Robin Reilley,M.S.
