BEFORE THE MINED LAND RECLAMATION BOARD <br /> STATE OF COLORADO <br /> Notice of Violation No. MV-2021-026 <br /> FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br /> IN THE MATTER OF POSSIBLE VIOLATION BY LKA INTERNATIONAL INC., CIVIL <br /> PENALTIES, CEASE AND DESIST ORDER, AND CORRECTIVE ACTIONS FOR <br /> FAILURE TO MINIMIZE DISTURBANCES TO THE PREVAILING HYDROLOGIC <br /> BALANCE, File No. M-1978-091-UG <br /> THIS MATTER came before the Mined Land Reclamation Board ("Board")on <br /> December 15, 2021 via videoconference to consider a possible violation by LKA <br /> International Inc. ("Operator"), civil penalties, cease and desist order, and corrective <br /> actions for failure to minimize disturbances to the prevailing hydrologic balance, File No. <br /> M-1978-091-UG. Lucas West, Travis Marshall, Russ Means, and First Assistant Attorney <br /> General Jeff Fugate appeared on behalf of the Division of Reclamation, Mining and Safety <br /> ("Division"). Kye Abraham appeared on behalf of the Operator. <br /> The Board, having considered the parties' presentations, testimony, and the <br /> administrative record, and being otherwise fully informed of the facts in the matter, <br /> enters the following: <br /> FINDINGS OF FACT <br /> 1. The Operator holds a 110-d Designated Limited Impact reclamation <br /> permit for a 3.5 acre gold mine located in Section 10, Township 43 North, Range 4 <br /> West, 6th Principal Meridian in Hinsdale County, Colorado, permit number M-1978.091- <br /> UG. The permitted site, known as the Golden Wonder, is located approximately 2.5 <br /> miles southeast of Lake City, Colorado. <br /> 2. The site consists of an underground mine and above-ground support, <br /> including a water treatment system to handle discharge from the mine's portal. The 6 <br /> level portal area, which is the focus of the mining operation, contains the portal, portal <br /> pad, shop facility, mine water collection pond, stormwater collection pond, crusher area, <br /> materials storage areas, and waste rock dump. <br /> 3. Water is discharged from this portal most of the year, typically with flows <br /> between .5 to 1 gallon per minute. Operator's reclamation permit includes a water <br /> treatment plan, and Operator also has a Colorado Department of Public Health and <br /> Environment, Water Quality Control Division ("WQCD")discharge permit. <br /> 1 <br />
