BEFORE THE MINED LAND RECLAMATION BOARD <br /> STATE OF COLORADO <br /> FINDINGS OF FACT, CONCLUSIONS OF LAW, AND ORDER <br /> IN THE MATTER OF THE NOTICE OF HOLCIM (US) INC. OF A FIRST <br /> PERIOD OF TEMPORARY CESSATION, File No. M-1977-168 <br /> THIS MATTER came before the Mined Land Reclamation Board ("Board")as a <br /> consent item on December 15, 2021, via videoconference to consider the notice of a first <br /> period of temporary cessation filed by Colorado Quarries Inc. ("Operator"), file number M- <br /> 1977-168 ("permit"). <br /> The Board, having considered the materials presented with this consent agenda <br /> item and having been otherwise fully informed of the facts in the matter, enters the <br /> following: <br /> FINDINGS OF FACT <br /> 1. Operator holds a 110(c) reclamation permit for an aggregate operation. <br /> The site is known as the Marrs Memorials. The site is located in Fremont County, <br /> Township 47N, Range 12E, Section 3, 101h Principal Meridian. <br /> 2. On November 5, 2021, the Division received Operator's notice for the first <br /> period of Temporary Cessation for the site. The notice stated that the product market <br /> had changed and that Operator had not sold product in over two years. <br /> 3. Operator requested an effective date of May 8, 2018 for this period of <br /> temporary cessation. <br /> 4. Operator has committed to comply with all reclamation requirements or <br /> other activities related to applicable performance standards while the min is in <br /> temporary cessation. <br /> 5. The financial warranty is adequate to cover current reclamation. <br /> 6. The Division has identified no performance standard issues in the notice <br /> or through an inspection of the file for the site. <br /> 7. Division provided notice to all interested parties of Operator's notice, and <br /> no interested parties objected to or expressed concerns with the notice. <br /> CONCLUSIONS OF LAW <br />
