debarment and reinstatement of Contractor, by the Executive Director, upon showing of <br /> good cause. <br /> INDEMNIFICATION <br /> Contractor shall indemnify, save and hold harmless the State, its employees and agents, <br /> against any and all claims, damages, liability and court awards including costs, expenses <br /> and attorney fees and related costs, incurred as a result of any act or omission by <br /> Contractor or its employees, agents, subcontractors, or assignees pursuant to the terms of <br /> this contract. <br /> PROJECT WORK DESCRIPTION <br /> This project involves reclaiming a portion of the Hard Scrabble Pit and reducing the <br /> highwall associated with Pond 3 at the S Bar C Farms Pit. See attached map for project <br /> locations. <br /> The Hard Scrabble Pit is a forfeited 240-acre gravel mine located in Prowers County, <br /> Colorado. The site is approximately 3 miles north east of the Town of Lamar. The Hard <br /> Scrabble Pit permit was issued in 1998. The State of Colorado, Division of Reclamation, <br /> Mining and Safety (DRMS) revoked the Hard Scrabble Pit permit and forfeited the bond in <br /> 2015. The previous operator is actively reclaiming portions of the site. The work involved <br /> with this project includes backfilling a large overburden stockpile adjacent to the pit, <br /> reducing the highwall slopes to 3H:1 V and revegetating affected areas. <br /> The S Bar C Farms Pit is a forfeited 656-acre gravel mine located approximately 1 1 miles <br /> east of the Town of Lamar. The S Bar C Farms Pit permit was issued in 1992. The DRMS <br /> revoked the S Bar C Farms Pit permit and forfeited the bond in 2015. Reclamation of the <br /> site occurred in 2016 with limited bond funds. The objective of this project is to reduce <br /> 2,500 linear feet of highwall on the north side of Pond 3 to a 3H:1 V slope, replace topsoil <br /> and revegetate affected areas. <br /> ITEM 1.0: MOBILIZATION/DEMOBILIZATION <br /> This task includes those measures necessary and incidental to move equipment and <br /> supplies onto the Project Area, to move equipment within the Project Area, and to <br /> complete any other requirements necessary to accomplish the goals of this Project. This <br /> item also includes all labor, equipment, and costs associated with demobilization and <br /> clean-up of the work site following completion of the Project. Please see Specification 1 .0, <br /> Mobilization / Demobilization of the General Bid Specifications, 2009. <br /> CONTRACTOR must comply with the following provisions during performance of this <br /> Project: <br /> No clearing will be conducted without prior approval of the PROJECT MANAGER and <br /> without an approved sediment control structure in place and functional, as required by <br /> PROJECT MANAGER, until construction is completed. Generally, silt fence, installed per <br /> manufacturer's specifications and Section 22.4 of the General Bid Specifications, 2009 is <br /> acceptable as a sediment control measure. <br /> CONTRACTOR will dispose of waste materials, including but not limited to refuse, garbage, <br /> sanitary wastes, spent solvents; oil and other petroleum products off of the Project Area in <br /> accordance with applicable laws and regulations.
