BEFORE THE MINED LAND RECLAMATION BOARD <br /> STATE OF COLORADO <br /> FINDINGS OF FACT,CONCLUSIONS OF LAW,AND ORDER <br /> IN THE MATTER OF THE REQUEST OF NUVEMCO, LLC FOR A SECOND <br /> CONSECUTIVE FIVE-YEAR PERIOD OF TEMPORARY CESSATION, File No. <br /> M-2008-050 <br /> THIS MATTER name before the Mined Land Reclamation Board ("Board")on <br /> seco <br /> December 15, 2021 via videoconference for a hearing regarding the request for nd <br /> consecutive period of temporary cessation filed by Nuvemco, LLC("Operator")for the <br /> October Ore Pile Reclamation,file number M-2008-050("permit"). Amy Yeldell appeared <br /> on behalf of the Division of Reclamation, Mining and Safety("Division"). Paul Szilagyi <br /> appeared on behalf of Operator. <br /> The Board, having considered the presentations, testimony, and evidence of the <br /> Division' and Operator, and being fully informed of the facts in the matter, enters the <br /> following: <br /> FINDINGS OF FACT <br /> 1• Operator holds a 110(d)reclamation permit for.5 acres of uranium and <br /> vanadium mining. The site is known as the October Ore Pile Reclamation. The site is a <br /> designated limited impact mining operation and is located in Mesa County,Township 50 <br /> North, Range 19 West, Section 4, 10"Principal Meridian. <br /> 2. On November 8, 2021,the Division inspected the site as required by Rule <br /> 1.13.15(4)of the Mineral Rules and Regulations of the Colorado Mined Land <br /> Reclamation Board ("Rules"). <br /> 3. On November 12,2021,the Division received Operator's notice for a <br /> second consecutive period of Temporary Cessation for the site. <br /> 4. The notice submitted by Operator stated that the first period of temporary <br /> cessation was scheduled to end on December 27, 2021 and explained that Operator <br /> considered the reclamation bond to be sufficient given the limited nature of the <br /> reclamation to be performed at the site, The Operator also explained that it had not <br /> recommenced operations or begun reclamation because it did not yet have all <br /> necessary elements to recommence operations and that reclamation was not <br /> warranted. Operator is actively engaged in seeking contracts and permits that it views <br /> as necessary to recommencing raining activity at the site. <br /> 'The Division was advisory staff to the Board, not a party, In this proceeding. <br />
